I130 approved but will not apply for visa yet

Hi everyone,

Our I130 was approved but we're not sure if we're going to pursue with the visa application right away (due to unforseen events). What will be the consequence, let's say, if we wait for about a year before completing the NVC part? Do we have to start with the I130 all over again? Or can we start where we left off?

Your I-130 approval notice has a date in which the petition is good for.

Your application will automatically go through NVC unless you cancel it. If you do not go through the process before the expiry date on your petition. It will expire and the process will need to be restarted.

Timeline

The NOA2 has an expirationdate and the visa has an expiration date. I think if u sum those 2, and also make the process relly slow, u can make it go for an year. like take yr time when sending documents, leave long breaks between packages, long enough for u but not too long for them to expire. then get the visa and not go right away. I think it has few months time limit. in that case u can still stay home for a year, and also not drop the whole process and start all over again.

(break in the process- Lee comes to spend holidays here 22 dec-5th jan 2009)

DS 3032 generated :? ?

DS 3032 sent : 26 dec 2008 (friend sends it, based on how fast Ds-3032 was generated for Sracastillo and others who had same NOA2 date as me-risky, but worked)

received AOS package and IIN number in mail : 29 dec 2008 (same friend picks up mail and sends us the IIN)

pay the AOS bill online: 29 dec 2008

AOS shows as PAID: 30 dec 2008

my husband goes back and bags with our papers get lost : 5th jan 2009

package IV fee bill generated and paid online: 7th jan 2009

recieved bags and papers: 9th jan 2009

sent AOS package: 9th jan 2009

package IV bill shows PAID and sending package IV : 12 jan 2009

case complete: jan 20th

interview march 30th 2009

NVC mails I129F package to bucharest embasy

up to this day, no package received at embasy here -one more reason to prove in my case I129F was just useless

Your application will automatically go through NVC unless you cancel it. If you do not go through the process before the expiry date on your petition. It will expire and the process will need to be restarted.

An I-130 won't won't just go through NVC without significant multiple inputs from the petitioner. They will infact keep the case open for up to a year. I'd go ahead and send the choice of agen form and simply hold your responses until you're sure you can immigrate within about 9 months, then begin moving ahead again. Even at the Consulate stage, you can delay some months if you notify them of continued but delayed immigrant intent.

The K visas work differently but petition expirations are routinely extended on those cases too, just not at the NVC stage.

Timeline

The visa is good for six months. So you can stretch the NVC process for six months and you will have an additional six months once you get the visa to travel. Some people in the forum have done this. A benefit is that if you come into the U.S. after being married for two years, then you will get the immediate relative residence which is good for 10 years instead of the the conditional residence good for two years and that need adjustment of status later on.

I don't recommend to wait another year just for the IR visa but if for other reasons you have to wait the year, then at least there is this one benefit.

I just looked at my NOA 2 letter and it doesn't have an expiration date. It basically says to wait until you start getting papers from NVC. So you will have to slow down the process of returning the papers to NVC.
