New and need help

Timeline

I came here on a work visa, I had two children since being here and have been here for the last 14 years. I want to know how to get everything straightend out so that I can someday marry the man that I have been living with for the past two years.

My friend told me about this site and is helping now. Any help is appreciated.

You are out of status; and your children would only be able to petition for you after they are 21 years old.

If you marry your boyfriend, you might be able to adjust your status. Consult an attorney. You can marry whenever you want.

I agree. I think, that you would have to get married, then file the I-485 to adjust status.

You have to first get married to a US citizen and then file to Adjust Status from your expired work visa to permanent residency. You will need to file forms I-130, I-485 and I-765 if you want a work permit while your Adjustment of Status is approved.

If you have more complicated issues regarding your stay or complications with your current status, then the best thing is to consult with a lawyer.

05/12/11 - Biometrics

07/20/11 - Interview - passed

07/20/11 - Oath ceremony - same day as interview

You enterred legally so you have every right to adjust status here after you marry. The best thing to do is get married and then file AOS and I-130 simultaniously. The sooner you do it the sooner you can stop worrying. Why didn't you get married before the children were born? The sooner the better.

Thank you so much for the help it is much appreciated. I was worried that getting married would mess things up or that I would have to go to Mexico to start the paperwork. So if I marry I can stay here and do the papers here?

I think so. Overstay is forgiven if you marry a USC. Good luck hermana.

It's also forgiven if you remain in the US during the whole process. If for some reason you need to leave the US, that's when you will encounter major problems. But as long as you marry a US citizen, file the I-485 & I-130, and remain in the US until you get your green card, you'll be fine.
