Will our baby be eligible for K2 visa when i gave birth prior the issuance or approval of our K1 petition?

Or is there a way we can inform the USCIS that the fiance is pregnant with the petitioner's child so the baby can be eligible? Of course the baby's name wasn't included when the application was signed then.

Or we will just file a separate application (I-130) for the baby after the birth?

I hope you can help me about this.

You need to register the babies birth with the US embasy as he/she will be a US Citizen born abroad, Baby will then get a US passport, so no visa is required. You may need to submit babies DNA to prove he/she is the child of your SO.

A US Citizen does not need a visa.... If the baby has a claim to citizenship then you need to get the consular report of birth abroad

YMMV

I spoke with a K1 beneficiary at church who was pregnant by her fiance' at the NOA2. She said that they will not permit a woman to fly if she's 7mos along or more, SO...she contacted the USEM and asked about expediting her interview. Nothing was guaranteed, but they granted it. She was able to travel at 6mos along to come to USA.

Moving on w/life
