Is it okay when you file a removal of conditions (ten yr green card) even it’s late like 4 days or a week???Need some advice PLEASE

09/28/08-green card received

1-751

07/02/10-mailed it 2day

07/06/10-they received my application forms

07/13/10-received notice receipt(gc extended for one year)

07/28/10-received biometric appointment

09/23/10 GC approved!!!

9/26/20 Gota pproval notice

10/01/10 GC receivedd

Why are you asking, from your signature you have another year before you need to file I-751, summer (2010)

I-751 is filed within 90 days before the 2 year green-card's expiration.

Well, I hope your friend has filed it already. Whatever happens will happen. Perhaps the holiday season can be blamed for failing to meet the deadline. Was there a good reason otherwise?

Timeline

You are supposed to file within the 90 day window before the card expires. If you file after that date you need to include the reason for the late filing. It is up to the adjudicator to decide whether or not they will accept the reason. Filing a few days after the deadline is probably going to be alright but you certainly don't want to let it go much longer. Tell you friends to get on it asap even if they aren't able to include all of the evidence right now - include as much as they can. Better to get it to them in a timely way and get an RFE rather than have it denied outright for being too late. They do need to make sure it includes enough evidence to make sure it isn't denied for lack of evidence though as well.

I've read of a case here on VJ where they submitted their I-751 after the 2yr GC had expired. They included a letter explaining the delayed filing. USCIS accepted their application.

Hope your friend has submitted his/her application already.

08/17/08: Mailed N400 to TSC

08/19/08: USPS attempted delivery

08/20/08: TSC received N400

08/21/08: TSC cashed check

09/02/08: Received NOA...........Priority date: 08/20/08

..............................................Notice date : 08/22/08

09/02/08: Received Biometrics Notification

09/18/08: Biometrics completed - Charlotte DO

10/24/08: Received Interview Letter

12/08/08: Interview @ 1:00pm. APPROVED!

01/05/09: Oath Ceremony 10:00AM. Now officially a USC!!!

01/17/09: Applied for US Passport and passport card

01/28/09: Received US Passport

01/29/09: Received US passport card

01/29/09: Received naturalization certificate back from passport office
