Mortgage and Removal of Conditions

I am wondering if anyone knows what is the impact of being in a pending status of I-751 application and bying a house during that time. We are planning on buying a house next year, and I have to apply for removal of conditions in January, my current 2 year Green Card expires in April.

Hi Senka,

I don't think it would have any negative impact. If anything, it can be used as additional evidence (God forbid if you receive RFE).(Im assuming question is whether buying home will have an impact on I-175 and not I-751 impact on buying home)

you are filing to CSC right? My 2 yr GC also expires in April, and we are sending pkg in January.

Yes, I will be filing to the CSC. I was concerned that pending status will have a negative impact on mortgage or other legalities of ownership.

I would not buy a house before gaining full citizenship rights. What are you going to do if an immigration officer feels like not admitting you into the country at an airport?

I have two houses and i don't see how it could negatively impact your case. I agree with previous post, it will just help your case. Also it shows more ties to US.

From a real-estate and banking point pending paperwork will not hurt your case. I was buying my second home while my case for removal of condition was pending and mortgage underwrite didn’t care. Bank or mortgage company would want to see all paperwork. However due to banking and credit crises rules are changing every day. So I don’t know if you will get approved for mortgage or not.

I'm not really sure where the risk is that you are implying. The USCIS likes to see co-mingling of finances (mortgage etc is great evidence). Personally having that size debt with your spouse certainly gives pause, and testifies to the relationship. Having a home together that you are both responsible for should send a strong signal, rather than renting month to month or whatever temporary situation.

I also bought a house with my husband during AOS, it was great evidence at the interview, and doing all the changes to it occupied my time waiting for an EAD. I've applied for ROC, and we are selling our starter home, and about to buy another house which we wouldn't have been able to afford in an up-market. But it's just my opinion, I'm just curious why you think it's risky.

you should not have a problem, the only issue could arise w/ the bank after your card expires, b/c they could ask about your residency status to decide your loan details, but they won't deny you a loan. they would rather get your money than loose it over a immigration matter.

I left several times and came back with no problems whatsoever.

I was concerned that the loan may be denied due to status pending or expired green card, that's all. I know it is a great evidence at the interview. I just think that bank might decide not to approve loan for someone whose status is in a limbo.
