i-751 approved without interview through divorce

I've not been approved, but I've filed I-751 (divorce waiver) and so far haven't received any RFE's... Looking at various timelines on VJ and other boards, I'm expecting to hear some good news in the next 1-2 weeks.

alawai and mza : please give ur detailed timeline etc, I think many I 751 waiver guys are waiting for one years plus.

I haven't been approved or denied. I had biometrics done on 10/25/08.

I've also not hear of anyone filing with a waiver taking 1+ years. Where have you seen that info?

Hi 3600rs it doesnt take that long for waiver its the same i think , i have a friend and i habe been seen many people here in visa journey it took them 5 to 8 months or last then that , it could be if u file in Vermont yes but California its pretty fast , one guy here got an approvall without interview he is from England u can look it up his time line.

Can either of the last two posters point me to boards / timelines posted that show that a good faith waiver takes 1+ year? I'm on 3+ boards and haven't seen anything showing this. I also don't see why it should take any longer for a good faith waiver I751 vs. a regular one. if USCIS are going to take >6mo to do this, I'll be looking into my legal options.

It's true that in past years permanent residents that self-petitioned to remove conditions after a divorce waited much longer overall for a decision. There's no real impetus on the part of USCIS to shuffle these cases through as rapidly as those jointly-filed, since aliens would be required to wait until they had acquired PR for 4 years 9 months before filing for Naturalization.

Can either of the last two posters point me to boards / timelines posted that show that a good faith waiver takes 1+ year? I'm on 3+ boards and haven't seen anything showing this. I also don't see why it should take any longer for a good faith waiver I751 vs. a regular one. if USCIS are going to take >6mo to do this, I'll be looking into my legal options.

Unless I am wrong the conditional part of the conditional status was that the marriage lasted that long. I think the theory is that if somebody only came to get a green card there is no way they would be able to stand two years living with somebody they didn't love.

In a case like this you are trying to demonstrate that the intent at the time of the marriage was not simply to gain residency. Since your marriage did not last then you have become suspect of fraud. What you are asking is a waiver of a requirement.

Your X husband signed his life away to keep you here on the I864. In the case where the intent of coming was only to gain permanent residency it is in the best interest of everybody except the immigrant that you return to your country.

In the case of a normal application the review would consist of looking very carefully at the paperwork to determine cohabitation. In the case of a review where the marriage has dissolved the reviewer must determine the original intent which might not be so obvious from the forms. There would need to be an interview and a more scrutinous (is that a word?) look at the case. It would surprise me if this happened in less than 6 months.

As far as options, I think the only option is to convince them that your original goal was the marriage, and not the green card. The only other option I know is to return to your country, some other country willing to accept you, or become illegal.

09 October 4th application package sent. This time they said the app signature page was a copy

10 Oct Sent package again 4th time.

25 Oct Received another NOA for Wife with $625 for the amount with one year extension

30 Oct 2008 Still nothing for step daughter. Checks still haven't cleared the bank

24 November Checks finally cleared the bank

February biometrics for wife Nothing for daughter.

thank you mermaid, thats a very important point. I have seen many waivers cases approved a few months before naturalisation.

can anyone direct me to a the list of i 751 waiver filers? I sent my application package on 07/31/08 and I was expecting to hear from them in about a year but cojnsidering what you are saying that might not be true.

There is no list. Joint petitions take a max. of one year and waivers a max. of 2 years from the date their conditional green card expired.

So waivers be ready for 2 years AFTER your conditional card expires.
