can i make an appeal to US embassy in Philippines

hello anybody could help please... i came on a k1 visa last december 7, 2007. my sons need to follow to join me within a year since i got my visa. Their interview date was Dec. 2,2008 but there was an allergy reaction on vaccination of my youngest so St. Lukes moved the interview date in Dec. 12 ,2008. We asked if it doesnt cause any problem since i will be 1 year already in Dec 7, St. Lukes said its just fine bec they r the ones who moved the schedule and that they are connected to the embassy. BUt when my sons went for an interview the Consulate denied them bec the date was exceeded 3 days already. we tried to explain that it was the St Lukes who moved the interview bec. of my sons medical situation. My question is can we make an appeal to the embassy or can we ask a certification from st lukes so that the embassy will give us consideration? I picked Dec, 2, for their interview and not dec. 12. they also took all the original documents what should we do now? pls help

I will not say not to try, but I doubt it. from Embassy website...

Children (unmarried and below 21 years of age) of a K-1 applicant may derive immigration benefits from the same I-129 petition and are issued “K-2” visas. Children identified in the approved I-129F petition are called “derivatives”. Derivatives may apply at the same time as the principal applicant parent or may apply later, but must be issued K-2 visas within one year from the date the K-1 visa was issued to the principal applicant parent. Derivatives who are following-to-join the principal applicant parent must apply for their K-2 visas in a timely manner to allow visa issuance within the required period.

the best thing to do is have your husband petition your son's as step child.

looks like St Lukes gave you some bad info. they do not have authority to change USCIS guidelines.

Go ahead and see if you can get St. Lukes to rectify the problem any way you can. Otherwise you guys will have to go thru the I-130 process.

Get your senator involved.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

do u know what are the reasons for a denial of visa if my husband will petition my sons as his stepsons ? we are just more cautious now coz we dont want this to happen again coz its hard to wait and wait for nothing and i miss my sons so bad ..my sister in Philippines cannot take care of them anymore coz she has 4 kids also to attend and her husband just died a month ago..so please let us know before we will start the papers again so we will be ready...thank u once again
