Some bad news and some more bad news........

First, I received a letter stating that we had insufficient evidence which is fairly odd because we have dated photos, signed letters from both sets of parents, etc. Have until June to send back more evidence.

.....but here is the worst bad news....broke up. moving in together was a big step and since I last touched base with you all we have broken up, she moved back to her parents and then we tried to get back together again but everything has fallen apart so it is off for good.

Is there ANY possible way to get a partial refund based on the insufficient evidence or separation?? I realize it is unlikely but assuming we were still together there would be little probability of our plans going through to marry this summer because of this new delay so it would have to be post-pone anyway so doesn't that mean I should get a partial refund or am I reaching?

I know everyone likes a good story so let me end by saying communication is very important, if you cannot speak to your partner on a level that you would speak to your best friend back in the states, you may both get frustrated, plus moving in is a big deal. You really get to know a person on a whole different level and that can make or break a relationship.

I am very sorry to hear about the break-up. (F) No one likes going through these things. Its better to find out now rather than later in the process and have more time and money wasted. In regards to receiving a refund, no I do not believe USCIS will ever issue a refund based on the separation. I would just send in a letter to USCIS saying that you are withdrawing the petition due to the break up.

Thank you all for your support. Will USCIS issue a refund based on not having enough photographic evidence and being unable to supply sufficient evidence in time to make travel plans because assuming none of this had happened our plans would have been totally screwed up.

Everything I've read is that it's nonrefundable. But you can always try. Good luck to you. I know it must be difficult.

I never would have believed my journey to happiness would begin with something called an "I-129F"

03/19/09 - I-129F Sent

03/20/09 - NOA1 (rec'd harcopy 3/26/09)

03/24/09 - Check cleared

03/25/09 - Touched

8/12/09 - Touched (4 hours before NOA2 email)

8/12/09 - NOA2 email received

***Received email at noon (Weds)

***USCIS site did update with the status

***Was 113 on Berkeley list; 156 on VJ list
