we have not began to do anything yet and won't be able to for a while so I just kinda want to get an idea of how to go about it all :bonk: , what would be the best way to go about it... to get married in Iraq may not be possible so maybe in another country, or how about getting the fiancee visa... refugee visa...

I have heard that the fiancee visa is the fastest way, but since he is in Iraq and we all know the current situation...

I know is not an easy process, but I've seen here it's possible... :wacko:

Is it worth it or any different to get a lawyer or I don't know... :blink:

You dont need a lawyer just because he is from Iraq. You most likely don't need one at all. If you have solid proof of a relationship, then you should be fine. (pictures with him and his family, any parties you had for engagement or marriage, etc). See the list of things to submit as proof of your relationship in the guides. Hopefully someone who has petitioned from Iraq will come along and give you more pertinent advice. You can most likely expect a more thorough security check, but getting to that point shouldn't be much different than the rest of the process. I believe K1 is faster for getting him here, but there are benefits to the marriage visas too. You just have to decide which one fits your needs and situation. For us it was getting him faster (which at the time we applied was doing k1) Good luck to you.

Same as the above poster - dont waste money on a lawyer, they cant move the process along any faster for you. Save the money for application fees, your wedding, ticket to see him or setting up home when he is here. Also the portals can connect you with folks from your SO's country if you chose.

Were doing K3 but K1 may be a bit faster - check the K1 forum for more info on that as well as USCIS website, new time frames should be coming out today or tomorrow.

I wouldnt say you need a lawyer.

we had a lawyer the time we stumbled upon this site...and had we found this site first, we would

have never spent the money on a lawyer...they cant expedite things for you anyway.

This forum is very thorough and the people here are very helpful..their experience and recommendation

of resources will be sufficient help on your journey.

We were married when I filed CR1...K3 was standard procedure and K3 came thru first. It still took almost a year

My husband got his interview for CR1 the same day his K3 visa was in hand so he stayed on the extra time and AP but now he is here with a greencard and it is smooth sailing for the next couple years.

Since your husband is from Iraq, you will have more options if you get married. There is another woman on here who filed for K1 last year for her Iraqi fiance and they are still waiting under security checks though his visa was approved. The K1 is a gamble but long security checks are pretty much guaranteed for any Iraqi male. I filed the CR1 and K3 (K3 never went through because I-130 was approved so fast) since I was married. If your married then your I-130 is automatically expedited through USCIS because he is a relative of a US citizen and from a war zone (I've seen Iraqi I-130s approved in two to three weeks). If you do a fiance visa (I-129F) then you don't get the expedite option so you could wait months for the approval (usually 3 to 6 months though it could take longer). Another thing is that once an Iraqi I-130 is approved then you will get a letter from the department of state saying he is eligible for resettlement to the US under the refugee program. Turns out the background checks are much faster for refugee than spouse visa and that is how my husband and another girl's husband got here quicker. He also has more benefits as a refugee and you will not need to do an affidavit of support for him coming as a refugee. I know that can be a problem for some people to meet income requirements to support their fiance/spouse.

Ditto on the lawyer. There's no need for one unless you have alot of red flags. We didnt use one until after we filed for AOS. IMO, having someone with a big stick to whack folks with is more useful when you are dealing strictly with offices in the US, rather than both the US and overseas consulates.

Where are you living now? If you can, I would say the DCF is the fastest, but you would have to both be living in another country for like 6 months. You can see my timeline below.... it's along a process.

We have a lawyer but it was a waste of money. He doesn't do anything or even answer my calls anymore. Just make sure you are thorough in your paperwork.
