He is just annoyed that he was getting a signing on bonus of $20k and now it has been taken away. All the gifts he purchased in advance of his advance are no longer paid for by the company that was hiring him. Whether it was fraud on his part, or his inability to understand the rules, he is a moron. I hope he bought a few extra sweaters - Canada is a little chilly right now.

Probably not the whole story here....but I'd have to say that he has earned the right to stay in the U.S. I note that he's a systems specialist and those types of people can be in their own world when it comes to legal esoterics.

I don't think anyone "earns" the right to be here (I'd make an exception for someone who actually fights for the US but is of a different citizenship).. Everyone does the same paperwork, pays the same fees and gets in line with the rest of us.. That's the point.. there's no miracle here, it's paperwork and a system, albeit inefficient and tremendously tedious at times (ask my friends who are trying to adopt internationally 2.5 yrs in paperwork nightmare with USCIS & foreign govs. and STILL going strong), but there is a right way to do things.. You do A+B+C and you get D.. it's not rocket science and this guy didn't fall through a crack. Like Flames said.. a simple google search or 1hr of research on this site for example would have answered the question he SAYS a lawyer ill advised him on (I still think after reading the story he misheard the lawyer).

Oh dear.

Awful situation to be in for his wife and kids.

I'd feel more compassion if his deceit and ignorance hadnt gone on for so long.

But......if the guy is in IT, I am pretty sure he can use the www to find out more, if he had really wanted to.

And I am a mere immigration law rookie, but I would have questioned the information given by the lawyer, as really it makes no sense at all.

If he wants.....i'll represent him and he can give me any sign up fee he gets for the next job he successfully applies for ;)

11/25/2009 - Started my new job!

02/26/2010 - Passed my driving test :-p

07/20/2011 - Eligible to remove conditions

2012 - Going for citizenship

09/20/2011 - Removal of conditions submitted to VSC....here we go...again!

It's been a quick and relatively painless journey thanks to tireless research, dumb luck and this community :)

DONE with USCIS for a while :)

exactly, he works with computers, the slacker I'm sure can use google!! If I was a boss and looking for an employyee, sure would not want him,lol

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1

I have a feeling he knew full well what he was doing and was just too lazy to fix it thinking he was somehow okay because he was Canadian and/or because he was married to a USC.

He allowed his work visa to expire 7 years ago. Now he's trying to make a sob story as if he can't make the same life for himself in Canada. I love how they try to tug at the heartstrings by saying: "He played Santa at his daughters school for all the kids..."

Hey kids Santa is getting his fat ### hauled back to the North Pole. :D

It doesn't take a genius to figure out that there are rules to follow when it comes to immigration.

I am an advocate of amnesty in the right situations. He has proven himself to be an asset to the community, and we should have more like him. Don't forget that USCIS was bollixed up 7 yrs ago after 9/11.

Amnesty? Are you SERIOUS? I could actually see it if he was going to be sent back to a country where the prospects were grim and it would be difficult for him to find work and opportunity, or his family would be in danger then PERHAPS his quest for the American Dream was a valid one.

HE CAME FROM CANADA........... He will be F-I-N-E.. and his wife has nothing to cry about.. it's honestly less than 8 hrs to the border from CT, she will be able to come home ANYTIME she likes.

Amnesty? Give me a freaking break........ call amnesty international.. i'm sure they would TOTALLY be interested in this case :bonk:

:lol: I found it nothing more than slightly amusing.

People who don't understand the immigration process are saying he broke the law after his one year visa expired...which is true. However, if he would have adjusted status after marriage, that over stay would have been forgiven.

I don't know how you can work in IT and never research status requirements online. Serves him right.

Ok, but how do you know that he is an asset to the community? Because he says the pledge of allegiance at PTA meetings? They also mention, when he got his new job, he called all his creditors and told them everything was going to be ok.

For all you know he is a guy who overspends and never pays his bills.

My point is, you don't know enough about him to make that kind of statement, in my opinion.
