Questions.....Yodrak, aussie, anyone????

I've been reading the posts here but its the first time i'm posting.

NVC has my I130 approved petition since March of this year; however, the status with USCIS still shows as pending. I spoke to USCIS about this several times including info pass appointment but no hope so far....should i continue doing what NVC asks from me? or is NO2 really needed at the interview? Im at the stage of sending the IV bill.

I have also filed I129f for k3. NVC today told me the petition will be sent out the consulate this week. They have assigned a case number already. Does this type of visa require I134 or I864?

I was employed overseas during the entire 2005. I did file my taxes & the income was above the poverty level but the entire income was tax exempt as it was foreign earned income leaving "0" on line 22 of 1040. IRS form 2555EZ is attached with my 1040 that shows the income as foreign earned & tax exempt.

I have recently joined another firm in the U.S and the present income far exceeds the poverty level. Do i need a joint sponsor?

Do i really have to submit copies of my tax return in case k3 kicks in before the CR1? instructions for I134 require tax returns in case of self-employment, as far as i could figure out. I can get a letter from my HR showing my current position, salary etc. along with copies of pay stubs.

I have recently moved, i've changed my address with USCIS & NVC, is a new G325 needed?

I'll appreciate any input from VJ members.

First of all, an updated timeline will help readers answer questions better. Looks like, your I-130 and I-129F were approved already. In most cases, K-3 requires I-134, but the consulate should mail the instructions to the beneficiaries where it would mention whether it is I-864 or I-134. However, your first part of the posting is not clear.

You don't need co sponsor, if your current income exceeds the proverty level. Someone can confirm this one. Also you would need to submit last 3 years' tax return for I-134 versus last one year tax return for I-864 along with W-2s. All information regarding I-134 should be mailed to the benecifiary for I-129F and regarding I-864, all information should be mailed to the petitioner.

No new G-325A is needed. You did your part to notify USCIS and NVC your new address.

It took 92 days for I-130 to get approved from the filing date

NVC Process of I-130:

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview

Hi, just wanted to throw in a general advice. You might not want to address specific people. You get more help by leaving it to anyone and sometimes people don't like to be asked for help specifically on a thread. They will answer you if they have an answer for you.

Now to your question: if your income exceeds and has exceeded the poverty guidelines, you will most likely not need a co-sponsor. However, it is in the consular's hand to request one if he/she feels this is necessary. Also depending on the consulate, if you need tax returns. I didn't need one, just had to turn in employment letter and bank statement, but other consulates or embassies require the returns.

As far as I know you won't need a new G325A if you updated your address with USCIS. They will change it in their system.

For K3 you will need I134, for CR1 I864.

The USCIS on-line status for my I-129f petition shows the case as pending, and I never received an Approval Notice. My wife has been an LPR for a year now. The Approval Notice is not required at the visa interview.

Use I-134 for a K visa.

Your 2005 income may have been tax exempt, but it was still earned income. It's your current income that counts, your income history is an indication (or not) of the sustainability of your current income. The income history that you've mentioned here should be neutral at worst, more likely a positive.

You do not have to submit past tax returns for a K visa. Even if the consular officer asks for the tax returns you can decline to do so if you wish and tell the consular officer to make their decision based on the information that you have provided. I wouldn't, however. Committing suicide is not my thing. I'd give them what they ask for since I would want the visa application to be approved.

After the petition there is nowhere in the immigration process that you, the petitioner, will be asked to submit another G-325A.
