I-130 and K-3 Visa

Timeline

Hey all;

Would like to congratulate those with recent approvals and especially those with visa in hand. The holiday season should be wonderful for most of you being together. I still wait on Vermont, but at least when I am here I know I am not alone.

Question; if my wifes I-130 goes through at the same time or before her K-3 and we decide to go that way, is the I-485 necessary at some point in tiime.

Question; Would it be possible for her to come to visit on a tourist visa just after the begining of January for her birthday while we wait? Of course she must return for the eventual interview in Kiev and to pack and of course to bring our little girl. Would this be enough to sway the embassy do you think?

Hi there. Congrats on getting your package ready to send off.

The I-130 is filed first and when you receive your Notice of Action 1 (NOA-1) from the service center that your petition was sent to, you may file the I-129F if you like. The I-485 is necessary if your wife enters on the K3 visa, she will adjust status when she enters the U.Ss

A tourist visa is possible but you must show the customs officer that your wife has STRONG ties to the Ukraine, these include a letter from her employer stating when she is expected to return to work, a bank account in her home country showing substantial funds, a lease or mortgage of an apartment or home in her home country, school obligations, etc. Just telling the agent that she will come home for her interview probably won't be enough.
