STUCK @ NVC for AP

guess i'm not in ap...whatever processing i was told my k1 was going though it was finsihed and my no2 approval was revoked by NVC and the whole petition was just sent back to uscis. i thought nvc had nothign to do with k1 other then assigning it a consulate number and sending it off..

Scary and disappointing. Let us know what you find out. Someone has to give you a reason. It might be lawyer time.

that's the funny thing..i already had a lawyer..and he can't get any info either. Wait 2 weeks for a letter from uscis..and yes i'm already working on getting congress involved again for the 2nd time.

Nigel told me to quit bitching and to just wait and be patient and go get a hobby, well I think that may be a very good idea, maybe get out of these 4 walls and stop comparing myself with other people, our time will come i suppose.

In your timeline you mentioned you had 2 refusals at the POE? Did you get those after you applied for K-1? Would it have anything to do with that? Just a guess... This is painful.

Sill in AP after 18 days. Getting dangerously close to upsetting travel and wedding plans now. :angry:

Hopefully, you haven't bought tickets. When is your wedding planned for?

Ours was pencilled in for October 10, but I just cancelled our venue reservations (no charge) and asked the photographer we'd reserved to "stand by" for a new date.

It doesn't matter to us when we get married, though, because we're not having anything fancy... just him, me and my daughter, hopefully my family... anywhere, with anyone legally authorised to marry us.

Can't wait for the day. :)

the refusals were because i had just moved provinces and did not have my own place or a job at the time. i was living with my sister. basically they told me in sufficient ties to Canada and they thought i was not comming back. it was in December and i was going to be with my fiance's family for xmas, this was before we applied. they told me to get blah blah blah as evidence and to try again, and that was the 2nd refusal. i was assured by many on here that that shouldn't impede my k1 process but who knows.

I dont think that would of caused this mess. Not at all. I know this sounds stupid, and please forgive me, BUT are you sure NVC said they sent your petition back to USCIS, maybe they said forward to embassy???? or forward to the NON IV section of consular?

A approval is a approval, NVC has no right to deny a petition, they are the "clearing house" for visas. ONLY USCIS has the power to give a approval or a denial!!!!

September 2, 2012, RFE Received.

October 15, 2012 ROC approved, 10 Green card on its way.

well i got this email today from nvc:

Good day,

Your inquiry has been received at the National Visa Center (NVC).

The petition has been returned to the U.S. Citizenship and Immigration Services (CIS-formerly known as INS). Any further inquiries should be directed to CIS.

My fiance David called nvc again, and he got "incomplete documentation", whatever that means.

i'm hoping csc just forgot to send the whole file morons that they are at uscis, and that is all the issue is. If not heads are going to roll. Congressman got back to us said he will inquire asap as to ####### is going on since he is the one that got our approval to begin with, or helped push it.

i dont know the technicalities of this on my noa2, but it sounds like my noa2 is no longer valid. even my lawyer is confused. blurgh..i just wanted to be home by xmas ya know?

Yeap I bet USCIS did not forward the complete file to NVC. Have you or David called the USCIS and see if NOA 2 is valid still? Speak to a supervisor at USCIS or better yet, email Wahsington, DC. I will PM you email address if you want it!!

Well i'm still in AP, but i dont want to phone them again....I called Wednesday, one girl said NO AP, one girl later on the day said YES AP, so personally I think they're all full of #######! Ahh well...I need a damn hobby and need to go for a walk but its like 105 degrees in Az and well, i'd die. LOL.

Me, too.. Did you ever get the "impatient woman"? I have a couple of times. She said, "This is still in AP" and I said, "Still?" lol She said, "Excuse me?" I said, "Is it common for K1's to be in AP for over 4 weeks" and she said (of course) "Yes".

Whatever.

Next time, I'm going to ask an obscure question to see what she will say.

Kimbear - Sounds like some paperwork fiasco instead of a denial for more complex reasons. I'm sure it'll be sorted soon. What a pain!

That happened to me a couple of weeks ago. First Mickey said No your not in AP

called back, yes your in AP. Been in AP ever since, I have not called today, UGH!!!!

I cleaned the hell out of the walk in pantry, took 2 hours to do, but took my mind off this nightmare of the K3 and the CR-1.

Guess the K3 is dead for us, almost finished with the CR-1 Oh well, worked out like this for a reason.

Well today's girl was ok but Wednesday night was a oriental girl and she was a pain in the b-hind and didnt want to do anything....

Damn frustrating!!! I went to the bookstore today and got a couple of books..see how long that will last me..
