:dance: Just heard from the NVC that we're out of AP and our file has been sent to the consulate! "Only" 23 days later... :wacko:

Finally, we are starting to feel like things are coming to a close and we can start living our lives together!

I hope everyone who is still stuck in AP gets their "good news" soon!

Amen to that, we just got out of this bs AP ####### on 8/4.. Im so sick of this whole process, tempted to write a story and send it to the media to expose these folks ugh!

hello everyone! This is my first post. We have the same problem with our K1-petition. We got approved already last May 22nd and forwarded to the NVC and stayed there for 1 and half mos and very unfortunately returned back to USCIS with no explanations. And just last three days ago we got a letter from the USCIS (Decision Notice) that says that our "visa application was already approved and forwarded abroad to the US Embassy/Consulate w/ the validity of 4 mos., subsequently was returned back to the USCIS w/ a finding that the beneficiary was not issued a k-1 visa. Since the period of validity has now expired the petition was not revalidated. Therefore action of this petition was concluded as of this notice, however the petitioner may chose to file a new I-129F for the beneficiary with fee."

That notice was so shocking to us! Does anyone ever had experienced like this before? how did u deal it? This is quite so confusing too. Our papers were not yet sent to the manila embassy how come we get expired? we keep track of our paper since it gets to the NVC they were the one who told us that they returned it back to the USCIS for further review.

Just need an advice to anyone who knows this case..your help will be so appreciated. God bless to all!

hello everyone! This is my first post. We have the same problem with our K1-petition. I'm sorry to hear this :( It sounds to me like a case of mis-communication or a computer entry error to me. The problem will be convincing the USCIS! If you have a good paper trail, which it sounds like you do, then you should be able to resolve this without re-filing. Let's hope so, anyway!

The only thing I can recommend is that you begin by phoning the NVC (since their operators actually pay attention to petitioners and may actually know something). More than likely, they'll have you call the USCIS service center as well, and you probably should. If you don't get anywhere with those two phone calls, then it is most certainly time to bring in your senator and congressman. Their offices should be able to cut through any bulls**t and redtape and get you some answers and hopefully a resolution.

Good luck and try to stay positive during the process. I know it is hard, but keep your eye on the reason why you're doing this (love will conquer all!) and stick it out.

Does the NVC actually notify you when your case completes AP? I was told I would be notified via email. :blink:

So were we, but it never came. We found out by ringing them, every day.

Yeah, we were also promised email notification. Never happened. NVC was able to send out four (4) letters at the start of our AP saying our file would be forwarded to the Embassy within a week (which clearly it was not). And they promised an email to tell us when our AP would end (which was never sent).

In short: communication from NVC cannot be taken at face value. You can be certain your file is actually at the Consulate when you get a Packet 3 or are otherwise contacted by the Consulate. Even when NVC told us by phone that we were released I was still waiting to get the Packet3 before I felt certain we had cleared that hurdle.

I call every day. I did send an email on July 29th for an address change. They just responded to it today (August 10).

It's annoying to wait at USCIS for 4 months and then get stuck again, but it's a bit easier to deal with this week. I hope it scoots along from here.

I just found out this morning that our visa has been selected for AP. Our NOA2 was July 27th and on Aug 3rd we got a notice saying our case had arrived at NVC and should be forwarded to the consulate in a week. I called NVC hoping to make sure it had been sent along (because it is so expensive to call the consulate). I was really bummed to hear the news. I hope it gets out of NVC soon. It looks like from reading this thread that times vary vastly.

I called NVC hoping to make sure it had been sent along (because it is so expensive to call the consulate). I was really bummed to hear the news. I hope it gets out of NVC soon. Where are you seeing that times are coming down? What would you say is the average stay for someone in AP?
