What to do if spouse decides not to stay?

Hello,

My wife has her conditional residency, and it expires 12/30/08. After much back and forth over the last 4 years we have finally decided to divorce and she is going to return to her native country. Does anybody know if we need to notify anyone that she is not staying?

We are not going to file to remove the conditional status. I have checked the USCIS website and I can find nothing about what to do if someone just decides to not stay. I do see where removal proceedings begin if we do not file within the 90 days before expiration, but nothing more. I want to make this as clean as possible should we decide to try our relationship again later and need to apply for visas and sech.

She can hand her greencard into immigration at the airport when she leaves or she can send it back to USCIS or make an infopass appointment at your local office and hand it in to them with a letter explaining she is leaving the US and is giving up here LPR status.

She can leave... her GC will expire naturally and nothing more needs be done

No need to return the greencard - my brother gave up his residency and just left without informing anyone. He recently came back for a visit - on a tourist visa - no problems.

July 7 Received Passport in 3 weeks

Shredded all immigration papers Have scanned images

Why not just get the restrictions lifted then leave? Since it is so close...

This way she can always return without a huge hassle.

They'd probably have to lie or divorce to get conditions removed. Doesn't look like they'd have time to get a final divorce decree.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship
