Hello,Im sorry of what happen but never think that nobody love you and care for you here....Maybe they dont have any idea how to help you.We understand what u feel.We know its not easy to have that kind of problem.In my opinion,u need to go a lawyer which is very popular in this case and tell them whats really happen.However,never think since you got a lawyer ...u didnt do anything also..u ask any information to other person.Try to open this site www.gurfinkel.com ..he is a lawyer and he is expert in immigration.

Get a lawyer that specialise on the Immigration process that knows In and Out of the sytem. The lawyer works for you not the other way, you pay him to get the job done. The only problem about lawyers are that if they know they are not making money of you, i.e. you won a settlemen and got his percentages, they wiull dump you. They are worst than IRS but there a few lawyers that are sinere. It takes time and money... GOODLUCK!

If you spent the money to fly your lawyer to JA for the interview - you would be paying for a vacation for the attorney. 99% of the time, the attorney is not allowed to speak at the interview - you are the ones being interviewed, not the lawyer.

As for your frustration - Join the waiting club - There are people who filed through JA that are still waiting for interviews, and they were approved before yours was -

THe issues with the fraudulent entry and jail time are going to come up at the interview - I wish you luck, but lawyer or not, that issue is going to cause you problems.

It seems that there is a very good chance that his visa will be denied, and perhaps that is why the lawyer didn't seem to be pitching in. Or, possibly, the fee you negotiated covered only getting this far--the petition being approved by USCIS. Now, it is up to the Department of State to act, and that is an entirely different set of standards. Be prepared to wait three months or more--no lawyer can expedite that process.

Now, I had a lawyer who have I guess basically filled out the paperwork for me and sent to USCIS.....

Now that everything is approved from USCIS and I was inquiring with him about the next step because I absolutely is lost to this immigration process and wanted to know how the process goes and the next step (after all I thought this is why I am paying him to help me through this process) He tells me yesterday (in short) that he never seen a person that emails so much back and forth and ask so many questions and he feels as though I need to find another lawyer... How about that..It really hurt my feelings because that's what I thought that's their job. We are almost done and now this. I don't know what to do. We got a lawyer in the first place because my husband got detained in Dec 2006 for attempt to enter US on fraudlet docs. he incarcirated for a few months and deported back to Jamaica.

I am stuck .....The lawyer has the pkt the NVC sent rqst the AOS and etc. I know we need waivers and so on I don't know which ones we need, perhaps the i601 and ? . But do I need to recruit another lawyer or do you do think I can do it on my own.... Or should I continue with the i129f then do adjustment of status.... I thought it would only take weeks after NVC received the info for an interview, however, the lawyer tells me months and that was the arguement..........I asked how is it months...............pls help...

I was just wondering who is your lawyer? He kind of sounds like mine in a way. One minute he is helpful and the other minute he is acting like I am the biggest pain in the butt. Even said he would have to charge me extra if there were any more issues with NVC. Just wondering if we have the same lawyer since your in NC

Wow, sounds familiar to my ugly lawyer issue. I fired my lawyer, and notified NVC of that. I emailed them, wrote them, and phoned them...plus, I got my congressman involved at that point. You may have special circumstances and I dont know the particulars, but I went on by myself, and my wife now has an interview DEC 16th.

We did everything ourselves with only a few small problems.

Dont panic first of all. Contact NVC and tell them your situation. They are not the enemy, even though they are painfully slow.

You can decide to either hire a new attorney ( I spoke with 3 after I fired the first one) or take a deep breath and go it alone. Its not hard, just the comfort level of thinking that an attorney is there for you isnt there. Once you pay the AOS, and you see things start to happen and you did it by yourselves, your confidence will increase. We were in your shoes only 3 months ago, and now we are 3 weeks from being a couple again...

Hey im gonna be honest with you.. I can see why your lawyer wants to dump your case. You are coming off as an spoiled child who isn't getting what he or she wants when he or she wants it. Especially by this insulant reply...

I can tell by your attitude your lawyer is just fed up with it.. You are right your lawyer is paid to handle your case answer your questions BUT he is not PAID ENOUGH to be your slave when you want every little question concievable answered He has other clients as well who he has to hande. You are not his only client in the universe and you should just sit back and be patient. You sound like an obsessive compulsive personality that wants to know everything so much to the point you will not let the lawyer do his job. Does that sound about right? Just take a chill pill have SOME faith in your lawyers abilities ask only IMPORTANT questions and don't worry wonder ponder the universe before your eyes...

But now I have said such terriblly horrible and mean things to you I wish you the best of luck in your case. Its punisihingly slow process. Expensive, You want everything to just get on with your life with the one you love. Its scary what if he gets denied? what if there is a problem? only thing you CAN do is take it ONE day at a time and each day you complete still in the rat race of immigration is one day you are closer to your goal... But if you worry about everything now you will go crazy before you arrive at the asylum.. Pray and have peace you will be much happier and your lawyer will thank you for it

Hi! I'm guessing your lawyer is just overwhelmed because it seems like you're going to have a big huge process involving an I-601 waiver for the fraudulent entry and potentially an I-212 for deportation if that was part of the situation as well. These are huge undertakings.

I strongly suggest that you visit the immigrate2us.net forum whenever you have the urge to ask a question. Nearly every possible issue related to inadmissibility and waivers is represented on there, and there are people filing at most consulates in the world. Sometimes it helps to hear from others who have a similar experience, even more than from a lawyer who is racking his/her brain preparing a waiver and possibly a battle at the consulate.

I'm glad things are working out with your lawyer, but if not, I suggest consulting with Laurel Scott. An email consultation costs $135, is super informative, and she's one of the most successful expert lawyers on foreign-filed waivers with all of the American Immigration Lawyers Association. I know I sound over-excited about her, but I know dozens of people who have a happily reunited family in the US despite crazy inadmissibility, thanks to her. So even if you just want a second opinion or something, I'd recommend her.

That's probably because you have a complex issue. People look at the arrest for breaking immigration laws and probably don't know how to help you. It's certainly not a common problem, so you might try a bit of patience. Do you really want 52 replies stating, "Sorry, I don't know how to help you."?

No, I don't but considering all the other issues and topics on here.. Y not ..... who know somebody somewhere may have experienced the same or close to the same and can provide helpful info............. Most ppl look at breaking immigration law, as you state, a surprising thing.....You have to realize ppl enter this country illegally everyday fraudlet docs or no docs trying to make a better life for themselves..........I see no crime in that, nevertheless, in this country it is..... This is God's land ppl should be free to move and go anywhere they please with the exception of ppl with bad intentions (ie: terriost) not everyone who get charged with a crime is a criminal, especially one such as that, in my opinion.............. Thanks for your reply. Just FYI my husband and I did get an attorney. Actually it's the same one. My husband spoke to him and he changed his mind.. However, I am not dealing with him directly because he and I clash, on the other hand, my husband seem to be a bit more humble than I so he will deal with the lawyer and I will deal with the assistant.. .. The current lawyer has been involved with the case since Aug 2007, so I will pray he will put his best effort and complete the case.

Do you think it is wise to get him to come to the interview also. I hope not because then we will have to pay for his plane tkt, hotel, and transpo................ imagine that..............

I dont think they are going to let him in for the interview. Several people have been in the same country as their SO for the interview and they werent allowed to attend. I dont think its really going to matter whether or not he is an attorney either.

I did not make any judgment about the arrest, and I did not say that you shouldn't post the question. I said that you need to be patient. The arrest makes your case EXTREMELY complicated and most people here cannot answer your question. Basically I was explaining why you had 52 views and no replies. It's not that people don't want to help; it's just that most of us CAN'T.

Thank you all for the replies............. I will definately check into these links and I pray things will work out for us. I really do. He has been back in his country now for 2 years almost 3 in june. His deportation order did say that 1-5yr ban unless approved by an Attorney General........ We have a 1 year daughter together, so I don't know if that will help or no. So I pray that him being home in his country and working as a manager at a hotel will give some sort of credit and they will excuse the crime and allow him here... I am also going to follow up with my local Congressman and to the person in Charlotte, NC.........I doubt if we have the same lawyer, this particular one is located in NY... I am going to think positive, stay in prayer, and keep the faith...............
