annulment and divorce???

Timeline

my fiance and I want to get married at the Church were both Catholic but the Church were looking for annulment.....and it says 6months processing before we got married.....is it any different between the divorce and annulment????? :blink: :blink: :blink:

1. An act of annulling.

2. The invalidation of a marriage, as for nonconsummation, effected by means of a declaration stating that the marriage was never valid.

this is what the church are bothered with. its legallity they are concerned with its religious belief,

forgot to add there is a legal difference between the two, divorce terminates the marriage and as you can see annulment is stating it was never valid in the first place.

divorce is a civil process while annulment (in the context of your question) is a church process.

our priest filed the annulment the day after my husband got his divorce granted (the civil process lasted for 6 months only because it was uncontested - minimum)

if the previous marriages were also in catholic church, you need to consult a priest. Annulment may or may not be granted depending on the situation and it will take at least 30 days or many years depending on your individual circumstances.

If your church takes six month to process the annulment then you should consider a civil wedding. If you let the I-94 expire you will be out of status.

I'm divorced. I was Catholic. I talked to a priest who advised me that if my first marriage wasn't in a Catholic church, then I could remarry in the Catholic church. However, I was married in the Catholic church for my first marriage. The only way the church would marry me for a second time was if I had my first marriage annuled. I was told it could take as little as 6 months, but more than likely a year to even up to two years! Don't forget that it costs money as well. I was just interested in how long it took as I had a g/f who years ago got her marriage annuled, and it did take 2 years and it involved a LOT. I think she paid upwards to $1000.00 when it was all said and done. I was one of the people that was "interviewed" for the process for her, and it was an interview at a parish, tape recorded, and was a question and answer interview that took about an hour. I lived 2000 miles away from my g/f at that time.

Because of my divorce, and my not being allowed to participate fully in the church, I left the church, and that's why I now say I was Catholic.

yes, there's a big difference between divorce and annulment....spelling wise (just kidding!). Annulment means a court procedures that dissolve's a marriage and treated as never happened, never valid due to some legal grounds. While divorce is the legal ending of marriage, separate and disunite. :star

Since there is no 'divorce' in the Philippines it's liley you will have to file for that and from what i've read here it does take some time.
