Using visitor visa to allow spouse in USA until K-3 approved??

My fiance and I will be getting married in her country in July, and we will not have the necessary documents approved (K-3 visa) approved until January 2007 or later. Is it possible that I could have her apply for a visitor visa to allow her to come back with me after we are married in July, while we wait for the K-3 visa to be approved?? Can someone give me advice on this?

Thanks!

Michael

You could try, but chances of being granted a visitors visa when married to a USC is pretty slim. As everyone is looked on as an intended immigrant when applying for a visa and/or entry to the US....being married can make this more difficult to overcome.

Hi! I'm in a similar situation, I have a visitors visa already ("laser" visa) and submitted a I129F for a K1 visa. But since it's taking soo long we want to know if we can just get married and apply for a K3 or adjustment of status later once we are back in the US. Is this possible?

Michael,

The reason you give for wanting a visitor visa disqualifies her for a visitor visa.

You can, but you'd essentially have to start the visa process all over again and petition for a spousal visa. The second you say 'I do', you nullify your basis for the K1 petition (a FIANCE/E visa).

The K1 is the fastest route possible, and even its pretty slow.
