Ontario Name Change.

Timeline

Hi there... about to get married finally and begin this huge process. I would like to take my husband's last name. Since we haven't filed yet, I'm assuming that will be okay? In Ontario, a spouse can assume a last name based on marriage which means that the name on my birth certificate won't change but using my marriage cert. or even the solemnization, I can change my name everywhere else including passport and whatnot.

So, my question is, is this going to cause trouble with the whole immigration process in the long run? Has anyone else done it this way and had either no problems or a whole lot of them? I'd really like to assume his last name, change all my stuff and then get going on the long process of the CR1.

Any help regarding this would be appreciated. OH and on another note, what the heck is with the registrar taking 10 to 12 weeks to register a marriage?? Is that time line for real? Just saying is all.

NOA #2: Approval June 25th, 2009 - 92 days

NVC

July 8, 2009 to August 10, 2009 - 28 days

Interview Assigned - December 3, 2009 - FINALLY!!

Medical - December 14, 2009 - Passed

Embassy/Interview - January 26, 2010 Montreal, Quebec Canada - 167 days PASSED!!!

Port of Entry - February 26, 2010 Baltimore International, Maryland

USCIS -- ROC package sent off

November 26, 2011 to Vermont station November 30, 2011 received NOA1December 16, 2011 received biometrics appointment.

January 04, 2012 Biometrics

September 2, 2012, RFE Received.

September 22, 2012 RFE responded to

October 15, 2012 ROC approved, 10 Green card on its way.

I concur that you will have no issues. I took hubby's name after our marriage and its not been a problem. All of the immigration forms have a spot on them to list other names you have used (such as your maiden name), so all angles are covered anyway. :)

No problems at all assuming your husbands name but not changing it on your BC. Just so you know, you cannot use the soleminization. You must use a legal document, either the legal licence issued by the province (usually comes before the marriage cert) or the marriage certificate itself.

Hi there,

No it should not cause any problems. Ditto pp who said that you cannot use the solemnization. I couldn't even use the marriage license; I had to have have the certificate. I have no idea why it takes so long but it does! I got married in ON to and the wait was so frustrating for me! I applied after 10 weeks and they sent me a copy of my marriage license instead of the marriage certificate (I sent that in to the NVC by mistake b/c I didn't realize it wasn't the certificate and so I got an RFE).

Despite that, my advice would be to apply for your marriage certificate right away and see what happens, since my certificate has a date of only 2 weeks after the wedding! You can always apply again after 12 weeks if you don't get it. Hope that helps!

2008-04-20 : Finally received marriage certificate from the province and filed 1-130 Petition.

2008-07-08 : I-130 Approved!

2008-09-15 : Received DS-230 and I-864.

2008-10-14: Mailed DS-230 and I-864

2008-10-30: DS-230 and I-864 received by NVC

2008-11-04: RFE

2008-11-18: Overnighted missing documents to NVC

2008-11-26: Case Complete at NVC!!

2008-03-02: Medical in Toronto

2009-03-23: Interview! Approved!

2009-04-04: The big move. POE: Blue Water Bridge. All went well.

2009-04-16: SSN arrives in the mail.

2009-04-24: PR card arrives in the mail.
