please Vj brothers and sister explain to me !!

Dear members ...

I want to ask about something i couldn't understand , My US wife Received I-797 c notice of action at 23 july 2008 regarding to our case I130 which we applied to get an action in 1 April 2008 , when i go to the official website of USCIS they say within 6 month's everything should be done and since last Sep my attorney always telling me its nearly done ... this week , Next week ...and nothing appeared yet !!!

Last time i called my attroney was before one week and he told me within 2 weeks i must hear anything from them !! .

Now i want to ask we are in nov 2008 and we applied to take an action of approved case I824 in 1 April and we received Noa I-797c at 23 july and till now nothing appeared !!! is that normal ??

2- how long shall i wait to received the Noa2 ??

3- im out of the timeline ?? i mean i waited more than 6 month's ??

if yes what shall i do now ???

I got my NOA1 on April 1st as well and have only one touch since then and am not approved yet. you are not outside timelines yet for I130. According to USCIS they are working on Feb 08 now. According to VJ which I think is more accurate they are working on March. Hang in there hopefully it won't be much longer fpr both of us.

My NOA 1 for the I-130 is March 28, the NOA 1 for the I-129F is April 4. My application for the I-129F/K3 was finally sent to an officer on Nov. 1. Have not received word yet on an approval. There is always the chance you may slip into the system early, but you should be prepared for a 7 to 8 month wait, there are many march and april filers who are still waiting to have their cases adjudicated.

actually he got his NOA1 on july 23 08. and april is when he filed ..it is supposed to be 6 months from the date on your NOA1. So that would be Jan 23 for your case, and even then you have to wait 30 days after from the time you reach 6 months.that puts you at feb 22 2009. now to answer your questions

1. yes it's normal to hear nothing.

2. is there an option other then wait ? patience & waitng is the biggest skill you will need on your visa journey

3. as descibed above. you are not out of your timeline

as things are right now, you have approximately 74 days before you can do much about it.

Lawyers know less then the VJ members. He does not know where you case is at or when it is close to being done. He can't get anymore information then you can by calling the USCIS now will he call for you unless you are way over the time frame. Lawyers are only good if you do not feel like dong the process at the expense of loosing valuable time and money.

May your journey be expidtied and smooth!

I had a lawyer cost me months of time and headaches. I fired him half way through the process and got a partial refund.

I have been waiting for almost a year on my NOA-2 for my I-130 from VSC..........so figure it out they are way behind on whatever they are doing.

12/04 met online

04/05 met in Hong Kong (2 weeks)

09/05 petition sent I-129 via lawyer (what a rip that was)

04/06 trip to Shenzhen, gave her diamond (to small boooo)

11/06 interview

11/06 DENIED "not a bonafide relationship"

02/07 married in Hong Kong & Shenzhen sightsee (1 month stay)

11/07 I-130 sent in

01/08 NOA-1

04/08 I-129F sent

05/08 NOA-1

11/08 sent letter to cancel OLD I-129F (2005) petition so no problems

11/18 received confirmation (email) letter received (VSC working on the old I-129F) quickest response ever from any governmnet agency !!!!!!!!!!!!

11/08 13 letters sent to Senate Judiciary Subcomittee Immigration

11/25 mailed me for more evidence, don't understand this delay new

I-129F (05/08)

11/29/08 received request for more evidence.......I forgot to check "NO' for domestic violence, homicide, manslaughter etc etc,

how stupid of me gezzzzzzzzzzz someone KICK ME please.

Also received action to the old WAC petition I-129F to reopen to withdraw petition.

12/01/08 I checked the "NO" box and sent in to VSC.

12/02/08 requested expedite services (need life saving operation)

12/06/08 received email new I-129F back in process mode

12/19/08 denial to expedite petition (unbelievable)

12/30/08 USCIS sending why the denial old I-129F (cant wait to get that response)

01/03/09 Finally received both NOA-2's today, my heart cant take it.

01/09/09 Received 1st letter from NVC for $70.00......no no no I want to process the I-129F. Got my birthdate wrong, have to fix that.

03/24/09 Interview........DENIED HK

This is going to be a NOVEL
