Hello Everyone,

I will be sending my I-129F on Wednesday and I think that I have everything copied and ready. The only thing is I feel like I have tons of evidence that shouldn't be in there. Maybe too much isn't an issue, but I am wondering if some of this stuff should be held off until the interview. I includeed, print-outs of my tickets for each trip, emails and instant message conversations, phone call records, wedding photos, letters confirming our relationship. Should I be sending these sort of things now, or should I wait for the interview?

You are right that all of that probably isn't strictly necessary, but there is certainly no harm in sending it. It will only help your case, so I wouldn't risk holding any of it back. They will certainly ask for it all again later, but having sent it in initially doesn't mean that you can't use it again at the interview.

None of this is required with the I-129F petition for spouse. You can save it all for the interview stage.

Marriage certificate and proof of citizenship as required. The I-129F tells you what to submit when using for a spouse.

All we sent was a copy of our id's (BC and passports), copy of our marriage book (certificate) and certified translations. We saved all that other "proof of relationship" stuff for the interview.

i don't get it.

This is the most prudent of the responses. It has happened that applicants showed up for their embassy interviews armed with evidence, and the consul refused to accept it (saying that "no evidence was presented") and either issued a 221(g) or an outright refusal. Including some proof-of-relationship information with your I-129F filing is insurance that the embassy cannot backstab you via the above technique. This is because the embassy will receive the evidence when USCIS and then NVC sends the package to the embassy, and the embassy cannot deny the existence of the evidence. This advice applies to all high-fraud consulates, including the one with which you'll be dealing.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

That may be true for a K1, but it was certainly not our experience for a K3. They didnt ask my wife for ANY evidence at her K3 interview even though we collected tons of it. The only time we had to show them anything was at the AOS interview and even then it was basic stuff like pictures, etc.

You were fortunate. The situation that I cited certainly did happen with at least one CR-1. We may not think that such evidence is necessary at the USCIS stage of the process (for what comes later), and we may be right most of the time, but we should also be prepared to be wrong.

Don't be overly concerned about how much is submitted as its not going to hurt a thing. Just make sure you have things tabbed for easy access. In fact, I was just making my Fiancee laugh tonight from the Philippines about my Petition for her. Your and my Petitions sound so similar. My petition is approaching 2" in thickness. I told her whomever opens up my Petition is going to say OH MY GOD. I have chat logs included from September to November included in my Petition.

01/05/12 - Mailed I-751, Petition to Remove Conditions.

01/09/12 - Petiton arrived us VSC.

11/15/12 - Wife Received ten year PR Card.
