Complicated situation please help.

Timeline

My girlfriend was in the US for four years. She overstayed her visa by a couple of years. Included in this mess is that she tried to get married once before but that didn’t work out. In the mean time she had already applied for a permanent resident status through her ex-husband. She filed for divorce and after getting together and seeing that she couldn’t really get anything done here she decided to move back to Brazil. We are now considering the Fiancée Visa option so I could bring her back.

Do you think our situation will get approved for a K1?

Do you think that if we go through with this she would be able to get her green card eventually?

Any help is appreciated.

This is one case where a consultation with a qualified immigration lawyer makes sense. With the overstay and previous filing, I would meet with someone who is very familiar with family immigration law to get a better handle on the situation.

Timeline

AOS

Mailed AOS, EAD and AP Sept 11 '07

Recieved NOA1's for all Sept 23 or 24 '07

Bio appt. Oct. 24 '07

EAD/AP approved Nov 26 '07

Got the AP Dec. 3 '07

AOS interview Feb 7th (5 days after the 1 year anniversary of our K1 NOA1!

Stuck in FBI name checks...

Got the GC July '08

This is one case where a consultation with a qualified immigration lawyer makes sense. With the overstay and previous filing, I would meet with someone who is very familiar with family immigration law to get a better handle on the situation.

Anyone else have any other opinion. I know its a really complicated situation but I am looking for something.

Did she complete her AOS thru her first husband? Did she ever get her conditional green card? If not, she may be facing a 10 year ban. Again, it would be a good idea to consult with a good lawyer. Heather Poole at humanrightsattorney.com and Laurel Scott at visacentral.net are both very good. Perhaps you can provide us with more details of your case.

I thought once you overstayed in USA you faced a 10 year ban and would not be allowed to return, like the posters above mention you really need to speak to an immigration lawyer.
