I've a neighbor who needs to file for his second wife. He recently had a child with her and also she has a child from her previous marriage so he has a step child.

So my question is does he need to apply 3 separate I130's and pay separate application fee for all of them?

USCIS I130 instruction says:

1. If you are a U.S.citizen you must file a separate Form I-130 for each eligible relative.

You may file a Form I-130 for:

A. Your husband or wife;

B. Your unmarried child under age 21;

C. Your unmarried son or daughter age 21 or older;

Also, wont USCIS combine all the I130s as it'd be kind of stupid to not give your wife and your child under 18 visa at same time.

Sounds like one of the kids may be a USC. If so no need file. If not they must vall have separate I-130s and separate fees.

First of all whats a USC?

And also how can the birth child get a U.S passport when the mother does not have a valid U.S visa yet. Just father being a citizen of U.S makes the child eligible to get a U.S passport?

Yes, direct USC parentage may qualify a child for US citizenship... the US citizen had better get reading

He can report the birth of his child at the Embassy and can directly file for the US passport from there. That was what we did for our daughter. So he will only need to file I-130 for his wife and step-child.
