Timeline

All, Your collective expertise has helped me get my wife into the USA from India as a CR1. We havent got the green card in hand yet. The news now is we are pregnant with our first child. I know there are absolutely no complications if we decide to have the baby here. My wife like all immigrants misses her family and feels comfortable having the baby in India. If we choose to do that, what status does the baby take? Would the child be a US Citizen, Indian Citizen or a green Card holder? Do I need to sponsor the child to come into the USA? What are some other complications, has anyone been thru a similar situation? What would you experts do if you were in our situation? Please advise.

Timeline

If you're a US citizen, you can go to the nearest US embassy and register the baby's birth. There they will give you a birth certificate and passport. And I believe a SS# as well, but I'm not sure on that.

07/20/11 - Interview - passed

07/20/11 - Oath ceremony - same day as interview

Most likely the child will have a claim to dual citizenship immediately from birth based on parentage regardless of the place of birth.... Now if you want, go ahead and have the baby in a third country and chances are the child will qualify for three citizenships ( 2 based on parentage, 1 based on place).....

If the child is born outside the US, then you submit a Report of Birth Abroad and if approved the child will receive a CRBA and US passport

Some important facts regarding this. While having a baby abroad is not expensive in terms of the birth and filing the birth abraod, it can have some serious impact on your family. One being time. From research I have done its very possible it could take upwards of 6 months to be able to bring your child home but each country is different.

Reasons:

1. It takes some time to get a valid birth cirtificate in some countries

2. It some times can take several months for a consulat to get to the paperwork and to aprove it.

3. Some airlines wont let a newborn fly international.

Congrats on your pregancy but you should go to the US Embassies for that countries web site and look for birth abroad. That is your best bet on figuring out how long it will take.

Got to love the fact my wife was preggy and even with a RFE @ NVC she was still here in under 5 months!

We just had a friend go thru the process of a foreign birth here in the Philippines and what the embassy required was birth certificate here and marriage also they were required to do a DNA test for the baby and the USC. then they issued a US passport, and SS number for the baby.
