New Baby's Citizenship

I am American. I live in Brazil with my brazilian huband. I just recieved my permanent residency here. And we were just about to apply for my hubands CR-1 Visa directly with the consulate, when we found out I was pregnant. We decided to hold off on the visa but we plan on continuing with plans after the birth.

But I'm not sure how it will be for the new baby. Can I report her as an american citizen? Do both parents need to be american to report an american birth? Will she automatically have dual citizenship? Will I have to apply for her american citizenship? I've found some conflicting information and nothing specific. So any info would be helpful.

Thanks.

Congratulations! :)

Ha, I will just say congratulations, just got a brand new granddaughter, just something about babies and new life. My present to me was a brand new leather covered recliner rocker so I can rock and spoil her.

As far as I know the baby will have automatic dual citizenship. My fiance and I had our daughter 18 months ago. When I first visited Brazil she was 4 1/2 months old and I obtained a visa for her with her US passport, they only allotted her 3 months on her visa and said that I would have to get her a Brazilian passport because her father is Brazilian. You can always contact the US Consulate to ask questions regarding birth abroad

1) Yes

2) No

3) probably

4) If you report her birth and it is approved. then she IS a citizen and will be issued a US passort... no other application needs be done after that

YMMV
