K3 Visa holder

Timeline

I got my wife to US from India in December of 2006 with K3 visa but did not do anything else since. I thought I 130 getting approved was the next step.. Now I got 2 more weeks before the visa expires, did I mess up? Was I supposed to file I485? What is my next step?

ANY ADVICE IS GREATLY APPRECIATED.

will it be too late now since she only has less than 2 months to go?

No.... she still has status as a K-3. File it while the status is curent... all is still OK... It is not a problem if her status expires after filing....

Removing Conditions

07/06/09 - I-751 sent to CSC

08/14/09 - Biometrics

09/27/09 - Approved

10/01/09 - Received 10 year green card

U.S. Citizenship

03/30/11 - N-400 sent via Priority Mail w/ delivery confirmation

05/12/11 - Biometrics

07/20/11 - Interview - passed

07/20/11 - Oath ceremony - same day as interview

will it be too late now since she only has less than 2 months to go?

No.... she still has status as a K-3. File it while the status is curent... all is still OK... It is not a problem if her status expires after filing....

Since she works, should I apply for EAD extension too? or will the NOA allow her to work too?

EAD card is totally separate issue... If it will expire, you can and should file for a renewal ....

The EAD renewal ought to be free if filed with a I-485.

On the positive side, since you waited so long, your wife will qualify for a 10 year green card rather than a 2 year conditional one. The I-485 application plus accompanying forms should then be the last time you ever have to deal with USCIS!

not the last time guys....the last time will be after the citizenship interview is done! long way to go!!

as because you waited so long she'll have to have another medical exam done in the US and I believe that has to be done and submitted WITH the I-485 for adjustment of status. Its going to cost you quite a lot.

First, you said you did nothing after she arrived on the K3, then you ask about her EAD. You must have filed for EAD. Yes, you'll need to file to extend that. She may lose her legal status to work before it's renewed.
