 Hi, Im new to this process.. My fiance and I applied for the fiance visa k-1 fiance visa April 22,2008 and this month 10/08 received an intent to deny notice , they wanted more information as to why I couldnt visit him in the two years prior to filing our petition. We filed April 22, 2008.

I know on the peition one of the reqirements is that you have met face to face with in two years prior to having filed. Unfortunately I wasnt able to meet him face to face with in these past two years, but have visited in 2004 and 2005, We have kept our relationship on going via the internet and web cam and on going phone calls etc . I submitted my response to immigration with documentation and verification as to why traveling would cause hardship it was received and status is processing..

My fiance and I met in 2003 via the internet and I visited him in 2004 for 2 wks thats when we made our engagement formal with his family. Then I returned to visit him in 2005 for 2wks.

My questions is have any of you experienced received an intent to deny notice because of not having met face to face in the two years prior to filing your petition....and what was your outcome?

I know I should receive a letter from them in about 90 days as to what is next or if they need more information.

Any information would be helpful.

Thank you.

The rules state you must have met within the 2 years prior to filing. I'm sorry; but if you really want to file, someone is going to have to make the trip to see the other.

Life's just a crazy ride on a run away train

You can't go back for what you've missed

So make it count, hold on tight find a way to make it right

You only get one trip

So make it good, make it last 'cause it all flies by so fast

You only get one trip

I agree with Jomo's girl. You have to have met in person within the two years previous to filing.

I have never seen a petition approved where the couple did not meet in person in that time.... even if they met previously.

I'm sorry.

You will not be able to overcome this denial. Your only course of action is to file a new petition after you meet in person again. This is one of the most common denials. It happens every time there was no meeting within the 2 years prior to the petition.
