Obtaining citizenship through marriage to a USC - when at the earliest?

Hello everybody,

It's been a while since I last dealt with USCIS (thankfully!). We got married in 2004, I obtained my conditional green card in 2005 and am due to apply for removal of conditions at the end of this year.

I just read in this forum that USC spouses can apply for naturalization after having spent only 3 (as opposed to 5) years as permanent residents. So this got me thinking - do the 2 years in conditional residence count in this period? Because if they don't, that would equate the total time in waiting to become eligible for naturalization to 5 years for some couples.

Your thoughts would be much appreciated!

Feb 20, 2007: Biometrics appointment '

Jul 11, 2007: Permanent residence approved!

May 16, 2008: $300 Check cashed

May 21, 2008: NOA1 date (received on May 28 in the mail)

May 23, 2008: NOA2 date (fingerprinting)

June 6, 2008: Biometrics appt in Boston

July 3, 2008: Interview letter received

Aug 27, 2008: INTERVIEW APPT!!!!!!!!

STAGE 2B - Applying for AOS to GC Approval - 9 months, 4 days (279 days)

STAGE 3 - Lifting Conditions. Filing (19 Dec 2007) to Approval (December 11 2008)

STAGE 4 - CITIZENSHIP (filing under 5-year rule - residency start date on green card Jan 11th, 2006)

*N400 filed December 15, 2011

*Interview March 12, 2012

*Oath Ceremony March 23, 2012.

In general, if you have been a Permanent Resident for three years and have been married to and living in a valid marital union with the same U.S. citizen spouse for all three years AND you meet the other criteria (Residence and Physical Presence, Good Moral Character, Language etc), you are eligible for naturalization.

So called "conditional residents" are Permanent Residents nonetheless.
