Hello...

Im new here and I guess we all have to start somewhere so here goes...

I need help on this....

My wife and daughter entered the US last Sep 99 on a tourist visa for medication of our daughter. They were granted a 6 months stay and before it expired, they requested and was granted an extension to stay which was to end Feb 2001. On Sep of 2000, or 5 months before the expiration of the extension they went back home (in the Phils)...

On apr of 2001, her father who is a USC (both her parents are) filed for I-130 in her behalf and last month (sep 2008), we were informed that such I-130 was approved. Does this approved I-130 means that my wife can now enter the US legally as immigrant and could petition me and our children?. How long will it take for her to be able to enter the US and petition us?.

um...I thought parents could only petition to sponsor UN-married children?

3rd Preference is for Married Sons and Daughters.

It does appear, however, that the petition was probably not filed as F3 in 2001 or it would not be current yet. I'm not sure how it is handled if you no longer fit the category of the original filing.

Yes, if her I-130 was approved she can now petition for you and your children.

From the USCIS website:

The relatives which may be sponsored as an immigrant vary depending on whether the sponsor is a U.S. Citizen or a lawful permanent resident.

If the sponsor is a U.S. Citizen, they may petition for the following foreign national relatives to immigrate to the U.S:

Husband or wife

Unmarried child under 21 years of age

Unmarried son or daughter over 21

Married son or daughter of any age

Brother or sister, if the sponsor is at least 21 years old, or

Parent, if the sponsor is at least 21 years old.

If the sponsor is a lawful permanent resident, they may petition for the following foreign national relatives to immigrate to the U.S.:

Husband or wife, or

Unmarried son or daughter of any age.

In regards to the timeframe, it could take awhile...I-130s for spouses and families can be very lengthy. So don't expect that as soon as she comes that you all will be soon to follow.
