(K1) need help with forms and idea where to start

Hi, I'm new to the community here, im james :)

me and my girlfriend are wanting to get married and live together.

She is from the USA and I'm from the UK. We have been looking into the K-1 fiance visa process and info. We have just come back off a holiday together :) first meeting, and we really want to tie the knot.

We've been together for about 2 years, met thru a friend online. We've been using Webcams, msn and the phone everyday since we first started talking. We're very much in love.

I've looked at all the required forms, looked at the k1 visa time flowchart

My questions are :

Do i have to wait until the interview here in the UK @ the usa embassy, and then go to usa?

Is 6 months an average time line for the k1 process?

Alternatively if i filed for the k3 visa went over to usa married her, then came back for the interview is that easier??

for the k1 visa is it not possible for me to stay in the usa while its being processed? or do we have to stay apart til the visa issuing:(

Cant the medical and interview take place @ the usa embassy in usa?

2) It can take USCIS up to 6 months to approve an I-129F, then there is NVC and The embassy. Use the timelines to get an estimate

3) No it is more complex (I-130 then I-129F filings) Also takes longer, if you do consider that aproach, the consider CR-1 and forget the K-3.

Consider CR-1 (I-130 only) compare timelines, and seriously consider the CR-1 visa, in most cases it only takes a little bit longer to get, and has the big benefit of NOT having to adjust status.

CR-1 has the big benefit of GREEN-CARD upon entry, NO ADJUSTMENT OF STATUS. K-3 CANNOT get SSN, WORK, or Get driver's license until they have EAD or Green-card, EAD can take 90 days or MORE to get.

K-3:

I-130: $355

I-129F: NONE

Consulate: $131

AOS: $1010

($1496)

CR-1

I-130: $355

NVC I-864: $70

NVC Visa fee: $400 ($355+$45)

($825)

I see many posts from K-3 holders stating, "Wow this sucks, I an stuck at home because I don't have EAD, DL, etc, or I am having hard time getting added to bank accounts because of NO SSN." K-3 has a 90 day or longer period of limbo while waiting for EAD or Green-card.

5) Medical is done in UK for the visa.

July 21, 2008---(ORIGINAL) NOA1 for AOS & EAD

July 29, 2008---"WALK-IN" BIOMETRICS DONE (AOS & EAD-1)

Oct 14, 2008---EAD1 CARD ARRIVES! Approval date is Oct. 2, 2008

Dec 10, 2008---INTERVIEW DAY! APPROVED!!!

Dec 17, 2008---WELCOME NOTICE RECEIVED

Jan 9, 2009---CARD RECEIVED FINALLY! Approval date 12-10-08..expires on 12-10-10

REMOVAL OF CONDITIONS

Sept 10,2010---REMOVAL OF CONDITIONS

CITIZENSHIP

Sept 10,2011---Application for citizenship

Is there a length of time we must have spent together face to face, or is that irrelevant. i think its irrelevant, i do have pics of us together tho and all the evidence of the holiday/flight stuff.

when for k1 visa's am i to pay the fees?

No there is no length of time you must have spent together face to face, you just have to have met within the last two years, which obviously you have since you just went on a trip together.

You pay the FIRST fee when you send in your I-129f packet.

Please read the guides that were provided for you or you can look at the top of the page.

IV-15 checklist says:

Marriage certificate* - the original or certified copy bearing the appropriate seal or stamp of the issuing authority for each of the applicant's marriages.

you dont have to be married already right lol? as its fiance visa :S

What checklist are you referring to? IV typically means immigrant visa which the K visa is NOT...

Does bringing my flight info like boarding pass, stamped passport, plane itinerary i have which was signed at airport = proof of engagement? i also have 1 pic of us together and the receipt from the hotel we stayed at.

just need a bit of re-assurance here

read this site, right at the very bottom, why would it list the I-130 as a form and fee to be paid for k1 fiance visa?

don't even read that site. it hasn't been updated since 2006 (the website date at the bottom)

then read the example forms here to see how to fill it out http://www.visajourney.com/forums/index.ph...p;page=examples

or even read the USCIS instructions that come with the form. you won't have to pay for a i-130 since you aren't married.
