Declined Visa: Rant + Help

I am not finished with the process of naturalisation, so I cannot ask for 129-F for my fiancee. Instead, she was trying to get a simple tourist visa to the US. At the embassy, the Immigration Officer typed in my name to the computer, said that there were no records of me in the database, and told her that the visa was declined! He didn't even ask her any questions! :crying:

Well, I certainly exist, which bring me to my question: is there any way to revert the decision? Any advice on how we can meet now?

Why did she mention you? What did she say?

January 21, 2008 - NOA1

March 16, 2008 - NOA2

August 7&9,2008 - Medical K1&K2

August 21, 2008 - Paid document verification fee (P1,300)

August 27, 2008 - Interview

September 08,2008 - Document Verification request sent to NSO

Spetember 19,2008 - Document Verification done -sent back to US Embassy Manila

November 03, 2008 - Case under review

November 26, 2008 - VISA printed

November 28, 2008 - VISA in transit

December 02, 2008- VISA IN HAND

January 12, 2009 - Arrived USA, POE Los Angeles

January 21, 2009 - Got married

January 22, 2009 - Applied for SSN

February 11, 2009 - Sent our AOS packet to Chicago

February 12, 2009 - Packet received signed for by L BOX

February 22, 2009 - Received NOA1 for AOS, EAD & AP

March 17, 2009 - Biometrics Appointment

March 21, 2009 - SSN card arrived in the mail

April 6, 2009 - took driver's license exam and passed! (written and road test)

April 10, 2009 - Repeat Biometrics Appointment

April 14,2009 - Received AP documents in the mail

April 16, 2009 - Received EAD in the mail

SEptember 4, 2009 - GREENCARD received

Timeline

She should have said with her relatives or a girl friend or in a hotel or that she is joining a tour group. She shouldn't have mention that she has a boyfriend or fiancee. Even if she is in good faith, the consul can not help but think that she will go there, get married and adjust status.

Even if you were a citizen the chances of her getting a visa, especially to visit her boyfriend or fiancee, are poor.

This doesn't sound right. I think it's likely that something was lost in translation. If she doesn't have major assets or if she is single with no children (that she would be leaving behind during her visit), then they would have denied her visa because she's high risk for over-staying. It's next to impossible for a single Russian woman to get a tourist visa to the US. Your status would have nothing to do with it.

I cannot remember where I heard it, but the odds of obtaining a tourist visa if you are a young, single lady with nothing tangible, being left behind in Russia, are around 2%. It is almost a sure denial. :(

I attempted to get tourist visas for friend in south america and I was informed by the woman who worked in my senators office that the state department has an unwritten rule that "No woman traveling alone whos originating country is considering a developing country will be given approval for a tourist visa" It was a waste time and money and Im sorry you had to learn it that way.

I would be surprised if it is as high as 2%

My sister-in-law (young single woman) was issued a tourist visa but she was here to visit her sister for two weeks and then return to school.

It is possible for a young woman to get a visa, but there has to be a valid reason, and staying with the boyfriend is an instant denial.

What should you do to meet now? Go see her or fly her to a neutral location in the Caribbean or something like that, meet her for a nice holiday, and then come back and finish up your naturalization then apply for K-1.

That's becoming the updated plan; it'll just take longer to see each other. But we'll be together, one way or another! :thumbs:

It sounds like you were planning on her getting a tourist visa and then marrying once she got here. You're VERY lucky your plan didn't work. USCIS would have seen it for the fraud it is and denied permanent residency. Be patient, wait for your citizenship to kick in, and you can apply for K1 immediately. Don't try to end-run the system, just be patient.
