I-134 and I-864 - good for how long?

Timeline

Hello,

We are preparing the I-134 and I-864 (both AOS) right now. For how long will the documents be good (after signing date)? We have the most recent tax return (2005) , and from our point of view, it would make no difference signing the documents now or later.

You wont need the I-134 for AOS just the I-864!!...............I know the I-134 is good for a year, i would imagine the I-864 is also as we have just had a new tax year begin!! :yes:

We did both K3 & CR1 visa's, got both!!- I returned to England for my CR1 interview after first arriving on a K3 visa!!

May/25th 2006- Green card arrives in the mail................YAY!!

19th June 2006 I Had to go to the Social Security Office to get my number, the DS-230 didnt work for me!!

26-June-2006- Social Security# arrived in the mail....YAY!!

Feb 2008 lift conditions <<<reminder to self!!<<<< went to England for a visit instead, no rush right, 90 days is a long time,LOL

Removing Conditions Begins

Mailed I-751 April 12th 2008

signed for @ NSC April 16th

NOA date April 16th

Conditional GC expired May 5th 2008

Biometrics Detroit May 10th 2008

10 year Green card ordered August 20th 2008

Citizenship any time from feb 2009

Third time today - this person is not talking about AOS adjustment of status, they're talking about AOS affidavits of support. They need the I-134 soon, for their K3 visa application, the I-864 later for their adjustment application. They want to prepare both at the same time, now.

You're fine, you're confusion was understandable. As was Michigan's confusing post. Sometimes acronym's should be avoided.

I guess Michigan figures it will be easier to do both at once, hoping that today's information will not change between visa and adjustment. For a K3 they may be right if the apply for adjustment promptly after entry.

Well, based on the time lines we have seen on this website, we expect the NOA2 for our I-130 and I-129f soon. That's why we are preparing them at the same time.

Does anyone know for sure that they are good for a year? Even six months would be sufficient ...

Michigan, your timeline and my timeline are almost identical.

I-130 Timeline with USCIS:

It took 92 days for I-130 to get approved from the filing date

NVC Process of I-130:

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview

According to the NVC generated instructions for the I-864,

Evidence of current employment or self-employment, such as a recent (within a month prior to the signature date on the I-864) pay statement or a statement from your employer on business stationery, showing beginning date of employment, type of work performed and salary or wages paid.

So it appears that the date of the stub just needs to be relative to the signature. :) However, according to the instructions, section General Filing Instructions:

For purposes of this form, a spouse or child is immigrating with an immigrant you are sponsoring if he or she is: 1) listed in Part 3 of this affidavit of support; and 2) applies for an immigrant visa or adjustment of status within 6 months of the date this affidavit of support is originally completed and signed.

and

The sponsored immigrant must submit the affidavit of support to the Government within 6 months of its signature.

For now, it looks like the I-864 is still 6 months. I guess there's talk (or action) about changing it (also reducing the I-864 tax forms to just one year), but until it actually changes, I would (and am) stick(ing) with what the form still says. ;) So it may still be a bit early to get all these signed and notarized. Remember that you still have plenty of time after your NOA2s. It took 3 weeks just to get a case number from the NVC for my CR-1 (to say nothing about how long it will take them to actually generate the form, which is still another step away). It took almost two weeks for the K3 to get through the NVC (we'll see how long it takes my wife to get the packet from the embassy) and will probably take at least another month or two before her interview when she'll actually need the I-134. However, there's nothing stopping you from getting most of it filled out (bio info isn't going to change tomorrow, right?) and leaving things like savings balance empty until you're going to actually sign it.

Just to clarify the issue with the tax returns for the I-864. It does appear that USCIS for AOS, many consulates as well as info coming from the NVC, that they require only the most recent. 3 years can be provided at AOS if it is felt it will strengthen their case. It does seem from what I have read that their is a new I-864 form due very soon which I imagine will reflect these new instructions.
