That's what I was told last night.

FWIW: this could be the extra IMBRA criminal background check.

If so, then when we get sent to the Embassy will be a good mark for the rest of you when you get sent to NVC IF the background check doesn't come from your respective SC.

Are you saying that they put you on AR??? and that you think this is because of the IMBRA law??? Being put on a AR can be from that but it might not be. There are other couples that were put on a AR as well that were prior to the IMBRA law. I guess what I am saying is I thought that they were calling this extra backround check something different than AR. I am not sure of course thats just my opinion. Either way I hope it doesn't take them too long to finish the checks on your case!! GOOD LUCK!

I called NVC last night.

I asked the status of the Petition.

They said it's in Administrative Review [AR].

I said can you please tell me what that means?

They said it is in Washington at agencies.

I assume this is probably the IMBRA criminal background check that post 3/6/06 petitions have to go through.

And that's "For What It's Worth" == FWIW

IMHO == In My Humble Opinion.

I know from other's on other boards that an AR, regardless of where it is, is a security check and you will not find out anything more until they're finished and release the outcome or a type of adjudication at that point. I watched this unfold last month on another BBS with a USC male who went to the interview thinking all was ok. The visa didn't come and there was no indication of a problem. Then they started checking and it was in "Administrative Review." She finally got the visa about a month later after the AR was finished probably a name check hit on her in Russia.

This AR is for me I'm sure; maybe this will speed up our progress instead of the Petition going to Moscow and then being sent back to USCIS somewhere.

I see.

Unfortunately, I don´t think this situation apply for the recalled petitions, since both NVC and USCIS told me my case went back to Vermont, ans they stated, police clearance certificates from the petitioners will be needed.

I agree with rlt. NVC has nothing to do with the necessary steps that need to be taken for the recalled petitions. The recalled petitions will have to meet the requirement before being re-approved and this will be done with USCIS at service centers.

Many go on AR at NVC level and it is mostly completed within 6 weeks.......results though are sent through to the consulate. If consulate is waiting on clearances and an interview has already been held, the visa will not be issued until it is complete.

I don't know is this matters but I just called the NVC regarding my case and she said that they had just recieved it and it should be on its way to my consulate soon. (F)

Officially a citizen. My journey took 6 years, 6 months, and 29 days

Well, I just called NVC to check on my status and found out that mine is also on AR. :angry: I was told it is very common, but I wonder how many other people actually had went through an AR at the NVC level? Is it really that common??

1. Summary: The International Marriage Broker Regulation

(IMBRA) was signed by the President January 5th of this

year. A 60-day deadline, March 5, 2006, was established

for DHS to begin asking K-1 fiancé(e) petitioners for

their criminal background information. DHS did not meet

the deadline for collecting additional information. Some

petitions filed after the deadline were approved in error

under the old procedures and sent through the National

Visa Center (NVC) to posts for processing. Approximately

1100 cases went to 95 IV-issuing posts. Posts are

preparing to return these cases as quickly as possible to

NVC. End Summary.

I read further down and the mention the DHS center though this doesn't say that; it says NVC.

Hi Maria/Larry=

I am sorry to hear about this. Since your NOA1 was dated prior to March 6, 2006, I believe your case has nothing to do with the new IMBRA regulations. It looks like you were one of the unfortunate cases to get caught up in AR. From what I understand, these AR checks are FBI clearances from Washington and can take up to 6 weeks or longer to clear.

The cases affected by IMBRA (My Dear friend was one of them) have been sent back from the consolutes to NVC. NVC will then forward it back to the respective service center for additional security checks under the IMBRA law.

Although I know it is easy to blame IMBRA on all the crazy happenings lately....yours does not seem to follow that pattern and they were doing AR checks on cases WAYYYYYYYYY before IMBRA!!!

Bwaadrent's NOA1 is 3/7/06. Is that right? that means their case is under IMBRA effect.

So it is interesting that their case is at NVC and not returned to CSC.

Does that mean California is processing cases of NOA1 3/6 or after?
