K1 Package to be resent

Hi Everyone,

We first sent out K1 petition late July and we recently found out that we had to refile due to an issue with the check. We called USCIS about a week ago and they advised that they will send our package back so we can refile. The next day we issued a new check to our lawyer in cali (from NY) via express post.

My question is, how long does it take for USCIS to resend our package back? Our filing center is Vermont and our lawyer is in cali (even though our lawyer has an office in NY, I dont know why they are filing from their cali office :unsure: ). Im assuming they will send the package back to our lawyer since they were the one that filed this.

I actually had mine resent for the same reason. I sent it out on the 25th of July. Received the package back on the 7th of August. Which is kinda ridiculous seeing how it only takes two days for mail to get back and forth between us with even normal post. So it might take a while, especially given your distance.

What really annoyed me was when we didnt hear anything after two weeks we kept calling to follow up on our petition but all they kept saying was to wait until another few days otherwise, call back - which we did on a number of occasions :bonk: . I guess we finally got onto the right person who then informed us that the package had to be resubmitted. I just hope it doesnt take too long...even though there's so many double handling..

And you hired a lawyer? Thats really smart...

Now, now...that was a bit uncalled for..As a matter of fact, we did...didnt know about VJ then and it was referral from someone else who used that exact lawyer who had a positive experience with them so we decided to give it a shot...oh well - people go thru different experience obviously ..

Just out of curiosity, what was wrong with the check?

The bank had debited the account that the money for the filing fee was in (one that we rarely use) and then reversed that transaction some time later. Im assuming it was the reason why the USCIS couldnt cash the check. Fiance had phoned the bank querying this but it was still partly our fault since we didnt keep a close eye on it. We've got the check resent now so thats all that matters...just hoping all goes well now. :)

Oh that sucks. Hopefully it wasn't anything you guys could have controlled. Mine was a stupid error where the check said "four hundred and 55/100" in the written area -_-. Needless to say I was angry at myself for that one.

There was no reason for the bank to debit money - hence the reason why they credited it back into the account. But im just glad that we finally got an answer from the USCIS...well at least yours is moving along now though which is good!
