I-864 Question

I will be using a joint sponsor for my I-864 (my sister). She filed her taxes jointly with her husband. My understanding is that I will need to file an I-864 and she will also have to file an I-864 along with her husband filing an I-864A. Correct? My question is, I only want to use my sister's income (she alone makes more than the 125%). In order to do this do I have to submit/do anything else? I remember reading a similar post a while back that mentioned that a copy of her paystub would be required since she filed jointly, is this correct?

If it is, does that mean I will only need to submit my I-864 and her I-864 along with a copy of her paystub?

Also, Will one paystub be sufficient?

Thank you for the advice! Sorry, if it sounds a bit confusing

I had an I-864 RFE, which is why I suggest being extremely thorough.

1) You will still need to file everything for yourself. I had a joint sponsor covering us totally, but the NVC still wanted proof of my employment. So include your taxes, W2s and paystubs or employment letter, or a letter explaining why you don't have these.

2) I recommend having your sister include tax returns or transcripts + W2s for both herself and her husband, along with her current paystubs (at least get a month's worth) or an employment letter.

Hope that works out!

Long story short, we have a complicated case. We've been at this for nearly 5 years. You can read our story here. I highly recommend our attorney Laurel Scott, as well as attorneys Laura Fernandez and Lizz Cannon .

Filed I-130 via CSC in Feb 2008. Petition approved June 2008. Consular interview in Mexico, Oct 2008, visa denied, INA 212a6cii. We allege improper application of the law in this case.

2012, started over in Seoul: I-130 filed DCF on 7/2, I-130 approved 8/8, Medical at Yonsei Severance 11/20, IR1 appointment in November 2012.

CRBA filed 1-3-13 at Seoul for our daughter

You will fill out an I-864 and so will your Sister - her Husband does not submit an I-864A - or anything actually - he is not a sponsor.

My question is, I only want to use my sister's income (she alone makes more than the 125%). In order to do this do I have to submit/do anything else? I remember reading a similar post a while back that mentioned that a copy of her paystub would be required since she filed jointly, is this correct?

You will want to submit her tax forms and slips from last year, this is evidence that shows what her income was - as opposed to what their joint income was. I see no instructions to indicate that you would need to submit her paystub(s). Can't hurt to include them I guess, as guatetaliana mentioned. As he/she also mentioned, you will need to provide all of your financial information and back that up with documents, for your I-864.

If a sponsor filed a joint tax return with a spouse, but is qualifying using only his/her own individual income, the sponsor must submit evidence of that individual income. This evidence would include, for example, the sponsor’s own W-2(s), Wage and Tax Statement, and if necessary to reach the income requirement, evidence of other income reported to IRS which can be attributed to him/her, usually on Forms 1099. link
