Is Non-Objection Certificate (NOC) required from the current job ??

I am asking this question on behalf of my cousin brother... My sister-in-law is having her CR-1 interview on Sep 18. She is currently working at a bank. Is she required to have Non-objection certificate from her place of employment at the time of interview ?? If yes, than what would be the format and what should it say on the certificate ?? Please advise... I am not totally sure on this ?? Did anybody had this suitation before or like to give their greatly advice to my cousin brother... Please and Thank You..

Bani, the answer is simple..NO.

US consulate does not require NOC.

NOC is not needed. But U.S consulate can demand the employment letter to verify the AOS. Normally, this letter will be part of AOS (I-864) forwarded by the NVC to the consulate.

Bani, she does not have to produce any employment letter. I meant the petitioner's (her husband's) employment letter as part of AOS.

Normally, consulate will never ask her employment letter. However, it is a good idea to take her employment letter (if it is easy to get) as part of my check list of applicant's all documents, just in case. Nothing wrong to collect as many documents as possible to support every single question on the visa application. In her case, it may not be needed. I read in another post that one applicant was working in bio-technology field and consulate issued a 221(g) to verify the employment - may be the suspecion about bio-terrorism! Who knows what would they ask ? In most of the cases, consulate has not bothered to ask any single document other than the mandatory docs too.

Only petitioner's Employment Letter is required. She (beneficiary) doesn't have to produce employment letter in 99.999% of cases. But as you know, Immigration Officer can ask for a letter to verify the employment but usually they don't.

Also, no one has to get NOC for immigration visa proceedings.... A company can't prevent someone from leavaing the job, leaving the country to unite with their family....

Hi Bani...are you excited about ur interview? I bet ur :)...as far as employment letter for ur SIL, if she is part of AOS then she'll need a letter (tell ur cousin) otherwise, i don't see any valid reason why would bombay embassy ask her for her NOC? She'll be leaving the company n going to US n thousands of ppl do every day. They just care about her Police clearance certificate mostly but like Loto said, if its easy to get it, then jus have it...cuz it'll help her when she comes to US....she can use that letter as proof that she worked in Bank n make her job hunting process easier from HR prospective. Good luck n update us about ur interview....jus few days away!

Hi Bani...are you excited about ur interview? I bet ur :)...as far as employment letter for ur SIL, if she is part of AOS then she'll need a letter (tell ur cousin) otherwise, i don't see any valid reason why would bombay embassy ask her for her NOC? She'll be leaving the company n going to US n thousands of ppl do every day. They just care about her Police clearance certificate mostly but like Loto said, if its easy to get it, then jus have it...cuz it'll help her when she comes to US....she can use that letter as proof that she worked in Bank n make her job hunting process easier from HR prospective. Good luck n update us about ur interview....jus few days away!

I am asking this question on behalf of my cousin brother... My sister-in-law is having her CR-1 interview on Sep 18. She is currently working at a bank. Is she required to have Non-objection certificate from her place of employment at the time of interview ?? If yes, than what would be the format and what should it say on the certificate ?? Please advise... I am not totally sure on this ?? Did anybody had this suitation before or like to give their greatly advice to my cousin brother... Please and Thank You..

Sure, i will forward this to my cousin brother..I asked my cousin brother to get my bhabhi's letter from bank as for verficiation purposes... If they want to verfiy her job...
