I know that you have to submit tax records for the past three years. In 2006 I did not make over the poverty level. My question is do I need to have a sponsor or do you only need a sponsor if you currently do not make over the poverty level?

The tax records you will need to provide will be 2007.. (optional to provide more) Did you make over the limit in that year?

If you made more than the minimum poverty guidelines in 2007 and are making more currently no need a co sponsor.

Yes, only include 2007. I would recommend including previous tax years only when it helps to "build" a stronger case. As the others have said, only 2007 is required.

I took some time of this year to travel to Peru and get married. I just started two new part time jobs. I have done some calculations and it seems that at the end of the year I will be right at the 125% poverty line or just under it. My question is should I secure a cosponsor? Will this be a problem or am I over analyzing the situation.

I am stuck in Vermont so I don't think we will have our embassy interview until early next year. Will my 2008 tax returns be requested at that interview?

If your interview is after April 15, 2008 you will need to have your 2008 returns ready and available for the embassy/NVC. If your interview is before Tax Day, then they should not ask for your 2008 returns as you are not legally required to file yet.

Since your 2007 returns show that you are 125% above the poverty level, it looks like you will be OK until Tax Day in '09.

you could ask someone to be a cosponser as a back up, but it will not be required until you are ready to fill out the paperwork. The consulates do request an updated version at the interview, so once you file your 2008 taxes next year, prepare the updated I-864.

Just little add from me,...I send for my case only for 2007 tax and went well with no problem now my case is completed and scheduled interview,...but I will have copies from 2006 and 2005 on my interview in embassy,..so If you send only now for 2007 for your case, make copies from 2006 and 2005 also when you would have interview in embassy, in case that they ask for those years.

Is it possible to file as the sole sponsor when I send the forms to NVC and then bring the I-864A form of my co-Sponsor to the interview in case they need one? Is this acceptable? I have a co-sponsor but would prefer not to have one if at all possible. Thanks

Yes, that's a good idea. Have the form filled and signed by your joint sponsor in case the embassy asks for it. One other thing, the I-864A is for a household members, so in order for them to accept that form the address has to be the same as primary sponsor.

If the addresses are not the same, just use another I-864 and click the appropriate box for joint sponsor.
