Well I have been looking this afternoon on the HRDC website with regards to the EI benefits. I can not find anything should you move to another country to marry. I earn over $50,000 a year and have worked at the same job for 6 years and have never applied for EI before in my life. I am wondering if anyone knows if we would receive the same amount as we would if we lost our job due to downsizing for example. The maximum benefit you can earn is 55% of $ 41,000 per annum to a weekly benefit of $435, so If i lost my job today I would qualify for that amount wondering if it would be same amount if I moved? Anybody going thru this. I tried to call HRDC but i was on hold forever!!!

when i received EI benefits after my move to the US i received the max amount. so in my experience yes, i received the same amount as if I had lost my job :)

AOS:

2007-02-22: Sent AOS /EAD

2007-03-06 : NOA1 AOS /EAD

2007-03-28: Transferred to CSC

2007-05-17: EAD Card Production Ordered

2007-05-21: I485 Approved

2007-05-24: EAD Card Received

2007-06-01: Green Card Received!!

Removal of Conditions:

2009-02-27: Sent I-751

2009-03-07: NOA I-751

2009-03-31: Biometrics Appt. Hartford

2009-07-21: Touched (first time since biometrics) Perhaps address change?

2009-07-28: Approved at VSC

2009-08-25: Received card in the mail

Naturalization

2012-08-20: Submitted N-400

2013-01-18: Became Citizen

Only difference between Canada and US is that in the US you get a max of 36 weeks. In Canada it can be higher depending on your location.

Yeah I had the same as Emancipation.

I guess you can see it this way. If you would quit your job in Canada to move in another province to be with your spouse you would be eligible to get EI as well. I guess they see it as a situation that you have no control over. Not like if you are just quitting your job for the heck of it and stay in the area. It's the same if you lose your job, you have no control over it. Other than if you purposefully did something to get fired then I think you are not eligible for EI.

So moving to USA to be with your spouse, it's not just like if you quit your job just to travel. Your are not changing country for fun. You are doing it to be with your family or spouse.

I guess that's the EI simplified :P I sound like a kid explaining that lol

Canada will automatically deduct 25%.

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1

How to file a claim for Canadian EI benefits for people residing outside Canada

You may file your claim for Canadian EI benefits on-line.

If you are residing in the United States and claiming regular benefits you must be available and actively seeking work and, most importantly, you must provide proof that you are legally authorized to work in the United States. You will also need to submit your Record of Employment from your Canadian employer.

If you are residing outside Canada in a country other than the United States, you may be eligible for maternity, parental or compassionate care benefits only. Regular benefits are not payable to a person residing in a country other than Canada or the United States.

The rates are the same regardless of what happened to your job, whether laid off or moving to the U.S. to be with your SO. - with the higher tax rate as mentioned.

CR-1 or IR-1 CAN collect EI as well, actually more straight forward for the cr-1 /ir-1 as there is no doubt they are work eligible!! And I believe once a K3 gets EAD,they too can collect EI

I collected EI way back in 2005. I was at the max and for some reason I think I was gettign $1200 or so after the 25% that gets automatically deducted. Not sure if that was every 2 weeks, or monthly!! Too long ago,lol I'm currently in RI and not back home in VA to check, but I doubt I saved any of the pay statements

UGH. Yes...forgive me. I think I was just more focussed on what he/she was applying for. I don't know if I knew that about the CR or IR, I did about the K-3, just knew that for them it wasn't immediately.

My Fiance and I are goin for the K1, I am pregnant, so I am glad to hear I wll receive my matenity benefts when I am in California!!, I think we get up to 52 weeks, an 55% of our gross earings up to a max of 413/week here in ON....thanks for all the great info VJ'ers!! :)
