Check the I-94 in his passport for the EAD stamp.

I see the I=94 what does the EAD stamp look like? It IS stamped but I don't know if it's EAD :)

Ah, then probably not. I *think* they only give the stamp at JFK.

I don't remember the exact wording, but if he had it, it owuld be obvious.

The stamp on his I-94 is the date he needs to leave the USA if you do not get married. It is dated 90 days from his entry to the US.

If he got work authorization you would see something along the lines of "Work eligible/authorized until ____". On my husband's I-94 it was stamped in red and it was one line.

They only offer EAD in NY JFK as Jenn! said. But you could ask for EAD once you get your AOS out ... buut in all reality you would probably get the AOS same time if not before the EAD ... so really in my opinion waste of money! Better now to get him "ready" for life in the US, and ready for working like taking coarses, et. Good luck and wish you both happy happy happiness!

If you can swing it I'd apply for the EAD if he is wanting to get to work right away. You never know if there might be hang ups with AOS or even how long the wait is. Before the big rush last summer it was a good chance you would get AOS same time roughly as EAD (my husband got his in june and aos in Aug, so for us it paid off, as he was able to continue the employment he already had). I know of 3 MENA people that took over a year to get their AOS due to misplaced files on 2 cases and just dumb people at uscis for the other.

You have to make the decision for yourself. Just giving you some other info to consider in making your decision.

Did he fly directly into atlanta or did he fly into JFK first? If he has a stamp, there should be a date written in pen. If you can post a pic of the stamp that would be great. If you don't see a date on the front of the I94 look behind. My husband's was stamped but on the back.

My husband found a job by the two-month mark. However, oddly his EAD stamp was good for 6 months and our greencard was x'ed and approved quickly so he was able to keep that job. He's been there now over a year. So it is possible, its good to get their CV recorded as a resume and have that ready for when they arrive.

1st K-1 Journey:

June 2005 - filed

October 2005 - visa interview

March 2006 - AOS packet mailed

DIVORCED

June 2007 - Interview

2008 - 10 year approval
