Three days after receiving Packet 3...

Timeline

He got Packet 3 on 5/16. Today, a letter saying approval of our case was rescinded pending a background check. It's the timing that annoys me so much. Why send packet 3 if they were going to send the case back to Vermont 3 days later?

Maybe there should be a slot on the timelines for this. I no longer have any way of judging when he'll be able to come over. Grrr...

Sorry to hear that. This IMBRA thing is killing us all. I hope they sort it out fast and get all cases moving foward again. I'm waiting to hear from the cases that were recalled to be moving foward again to know things are back on track.

It's a perfectly reasonable law; I have no quarrels with it. But there are already so many different government agencies with their fingers in this pie that I can't see this happening efficiently.

Oh, well. In the grand scheme of things, I haven't been waiting all that long since the beginning of our application. I'll just hope for the best, I guess.

I've been following your case closely since your NOA1 was only a day ahead of mine, and I was a bit down that you got your NOA2 so fast and I hadn't gotten anything, but I guess if I had gotten mine around the same time as you I'd be frustrated now that I'd have been recalled as well. I do hope our cases will move on faster as soon as they finish doing those IMBRA security checks.

Maybe they haven't issued your NOA2 because they started your background process earlier. I'd have preferred waiting a bit for that to be done than to get the approval and have it yanked back, tbh.

First of all I am very sorry to hear that you all are having to go through this whole thing! I could not imagine how that feels! To be optimistic a bit... I think that once your petition is sent back they will do some quick checks.. I have heard some only take like a day or so and then you will have had time to fill out your packet three and checklist and be completely ready for the interview! it gives you some time to prepare yourselves fully!! I am also pretty sure that the embassies are keeping track of the petitons sent back so that as soon as they re-receive it you will immediately receive your interview date! They are probably putting recalled cases in front of the cases that are not yet approved so you will hear something soon I am sure!!

Luis and Laura, I know that you are upset about your case being halted in a way but you did have a few touches early on and they were probably getting ready to work on your case if they hadn't already so yours has got to be on the top of the list!! Just be patient and it will come. I know it sucks that when you thought going through Vermont would be quick and painless you give your hopes up and then they do this to you..I would be so upset too but you still don't have it as bad as the people who would be backed up from this at the other service centers so Im sure Vermont will come through for you guys soon!! Hang in there...It will be over soon!! :)

Your welcome, You have every right to be feeling bad for yourself! we all do. I am the most anxious, impatient person in the world!!! i would have probably have had a heart attack if i was going through what you guys are!! But everything is gonna be fine! On the bright side for you though.. at least you are getting this over with now!! this is the hardest part of the whole process and I would rather be in your shoes and have to wait now than later after you get your approval and interview. Once this part is over and that approval arrives in your email its like a weight is lifted off your shoulder and it will feel so good! Everything goes so much faster too once the NOA2 arrives..trust me!! You guys really seem to know your stuff so you will do great at your interview!!

I'm wondering now what we should do with packet 3; he hadn't had a chance to send the forms to the Embassy before he got the letter stating that the case had been sent back to Vermont. Should we wait until the background check is complete, or will it speed things up if we send it to the embassy before that happens? How will I even know when the check is done? Will they notify me?

Probably no one has any answers to these questions, as the whole situation is so new. I guess my best bet is to call USCIS on Monday.

It's just so frustrating to feel that the end was almost in sight, and suddenly jump back two steps. Thanks for the support, everyone.

I'm in the same situation, I received the recall letter before I had a chance to mail back the packet 3 forms to Montreal. I called the Montreal Consulate about it and they said I should wait until I hear from them as they won't accept my packet 3 forms until the petition is reapproved. I think you should call the Embassy and see what they suggest.

Guys,

I´ve been calling the whole world since May17th and the thing is: USCIS will only tell us something once they have received our case back from the Consulates.

So, specially for those from Vermont (they seem to have stopped approving petitions since April), what we should as is:

1 - Is the VCS waiting for any notice to restar approving petitions in general?

2 - About all recalled petitions: Are they going back to Stage 1 or are they gonna be on top priority?

3 - For those who do not had their petitions returned, but are yet waiting for a long time since Vermont has stopped: Are the recalled petitions causing delays to all others petitions?

I suggest this because THEY WILL NOT tell us about each particular case!
