Did you file 'Married filing seperately' in 2006? Even if she didn't have any wages to report, did you mention her on your return?

Your timeline says "Remove Conditions 11/08", but it looks like your GC expires on 11/08. Your window opens by the third week of August.

It looks like you were eligible to file a married joint return for 2006. You can always amend. You might have left some refund dollars on the table!!!!!

Hi HB34,

Personally, I wouldn't worry about not having enough joint tax returns. I would just submit the 1 (2007) tax return that you have, and simply provide an explaination as to why you didn't have the 2006 tax return. If it makes you feel any better, I don't have any tax returns to submit (yes, it's a perfectly legal situation in my case), so I had to make do with the explaination there. In lieu of the tax returns, I would send other additional joint evidence covering the co-mingling of finances and of other types of evidences that they want to see.

It looks like you were eligible to file a married joint return for 2006. You can always amend. You might have left some refund dollars on the table!!!!!

Yes I could have filed married joint return. However she was tax exempt because she worked as a J1 student for the sumer so I didn't even both putting her name on the tax return. Putting her on my return as exempt would have made it much more complicated than it had to be, besides she only earned less than 10k.

I do not understand how it would have been complicated because it is certainly not complicated....

While a majority of the time filing jointly lessens one's tax liability because of favorable MFJ rates when compares to single or MFS rates, you may have been one of the few who would not have benefited..

No we didn't file her taxes at all. Do you guys think this will really be a big deal?

They are going to check to see if she worked???

Technically if some one is a permanent resident at the end of a calendar year and has been in the US for at least one day in that year, she/he needs to file taxes for that year.

I don't know if it will be a big deal, or even if the two govt agencies talk to each other, but if it was me or my spouse, I wouldn't take the chance and I would file an amended return.
