Timeline

The way that I initally understood filing for citizenship was that it could happen 3 years after the non-citizen arrived in the United States. However now I've heard that you can file after the non-citizen has had his PR for 3 years. Which is it? Our timeline is:

Jan 25, 2006 - Husband Arrives

November 23, 2006 - Husband gets conditional residency

August 23, 2008 - Husband applies for 10 year green card

Nov 23, 2008 - Green Card expires

Jan 25, 2000 - Apply for Naturalization? or

November 25, 2009 Apply for Naturalization?

May 11 '09 - Case Approved 10 yr card in the mail

June - 10 yr card recieved

Feb. 19, 2010 - N-400 Application sent to Phoenix Lockbox

April 3, 2010 - Biometrics

May 17,2010 - Citizenship Test - Minneapolis, MN

July 16, 2010- Retest (writing portion)

October 13, 2010 - Oath Ceremony

Journey Complete!

Timeline

On the GC there is a Resident Since date. You are eligible for citizenship via marriage three years after that date. You may file 90 days before the end of those three years.

Lansbury's right, and given the dates you've posted, he'll be eligible to send in the paperwork any time after August 25, 2009. Also, it looks like he can't file his I-751 until August 25, 2008. (note that 90 days isn't the same as three months -- August and October have 31 days). If in doubt about the calendar math, wait two or three days before filing.

He'll be eligible for citizenship as soon as November 23, 2009 at the earliest, if they work on his paperwork really really fast. Realistically, they probably won't have finished his paperwork until something more like January of 2010, but paperwork delays are notoriously unpredictable.

Review the M-476. Continuous residency is only one of the requirements, though it's often the last one to be fulfilled. Make sure he's fulfilled all of the other requirements listed in the M-476, too.

05 Apr, 2004: I-130 Sent to CSC

13 Apr, 2004: I-130 NOA 1

19 Apr, 2004: I-129F Sent to MSC

29 Apr, 2004: I-129F NOA 1

13 Aug, 2004: I-130 Approved by CSC

28 Dec, 2004: I-130 Case Complete at NVC

18 Jan, 2005: Got the visa approved in Caracas

22 Jan, 2005: Flew home together! CCS->MIA->SFO

25 May, 2005: I-129F finally approved! We won't pursue it.

8 June, 2006: Our baby girl is born!

24 Oct, 2006: Window for filing I-751 opens

25 Oct, 2006: I-751 mailed to CSC

18 Nov, 2006: I-751 NOA1 received from CSC

30 Nov, 2006: I-751 Biometrics taken

05 Apr, 2007: I-751 approved, card production ordered

23 Jan, 2008: N-400 sent to CSC via certified mail

19 Feb, 2008: N-400 Biometrics taken

27 Mar, 2008: Naturalization interview notice received (NOA2 for N-400)

30 May, 2008: Naturalization interview, passed the test!

17 June, 2008: Naturalization oath notice mailed

15 July, 2008: Naturalization oath ceremony!

16 July, 2008: Registered to vote and applied for US passport

26 July, 2008: US Passport arrived.

Is there any way to get an actual hard/paper copy of the M-476? It drives me insane trying to read 65 pages on a computer screen! If not, I guess I will have to make sure I'm stocked up on paper and ink for my printer.....

NOA received 29 May 2010 (dated 24 May)

Biometrics Appointment Letter received 17 June 2010

Biometrics scheduled for 08 July 2010; walk-in successfully done in Philadelphia 07 July 2010

02 Oct 2010 - FINALLY got email saying the case was being transferred to the local office. Hoping to get his interview letter soon...

05 Oct 2010 - received interview letter!!!!

08 November 2010 - scheduled for N-400 interview

- went together for interview; file isn't there - need to wait to be rescheduled

Jan 2011 - went for Infopass

25 Feb 2011 - interview

19 April 2011 - Infopass

8 July 2011 - HE'S FINALLY A CITIZEN - WOO HOOOOOO!!!!!!!!!!!!!!!
