Hello, all! New guy to this forum, hoping to tap into your knowledge.

My girl got finally divorced yesterday, I have all the necessary paperwork on hands, plus some supporting evidence. The only thing I am missing is a document confirming that she's divorced. Which is a better idea: to send the package anyway, and then provide the divorce decree at request, or wait another week or so to receive a copy of the divorce decree?

PS Forgive me if this has been covered before, I tried searching, but found nothing.

What could happen?? Well, they could send you an RFE, and you'd then have to respond to that, and it could slow down your petition who knows how long! Or, they could send you your RFE, which could get lost in the mail, and you could just get a denial for not having sent the response to their RFE, that you said you never got in the first place...

gosh, why would you want to set yourself up for more hearthache? Or heaven forbid they just send the whole package back to you because your not eligble!

The instructions are quite clear as to what you have to include in your initial application. Wait until she gets the divorce decree and sends it to you to include in the package. You might have to wait a few weeks for this, but it will certainly it's better than the above scenerio.

Thank you, that's what I was looking for.

As you go forward with the visa and status adjustment processes, you would be wise to proceed under the assumption that failing to read carefully, interpret literally, answer accurately and do as instructed, will have a heavy consequence.

You both need to prove you are free to marry, otherwise it will hold the process up longer because, as Carla stated above, you will receive an RFE. You need a copy of her certified divorce decree and also of her marriage certificate if she has changed her name at all since birth.

Hey 412, looks like we have something in common, only it was I who had to provide my Divorce Decree, not my fiancee. At the Vermont Center, a very good color copy of it was sufficient, but the US Consulate in Bucharest is asking her to bring the "original" with her to the visa interview. Hope this helps.

Yes and no. My girl lives in Transdnestria, which is a a breakaway region of Moldova. :wacko: Yeah, I know. And I had to provide a copy of my own decree as well, but I had that one for awhile ;)

I got a very nice color scan from her, and just printed it on a laser printer, and did the translation myself.

Why Bucharest? There's an embassy in Chisinau, no?
