K3 VISA Restrictions

I am bringing my wife to the states via a K3 VISA through a 129F Fiancee VISA....my question: until we file for adjustment of status can she work? And can she get a driver's license here in the states? I am a US born American.

Also, I have sent off the initial 130 Petition. I saw that USCIS has withdrawn the fees from my bank account....does this mean I can relax and the Petition is being processed with no issues? And if so, how long before I should expect the reciept?

Any info woud be helpful, thanks

K-3 visa is not work authorized. Along with your AOS form I-485, you can file for EAD (employment authorization) using I-765. This will permit her to work until she gets her GC.

Driver licenses vary by state in terms of requirements.

If they cashed your check, you should get your NOA1 shortly (a few days to a week). The fact that they cashed your check means that the fee you paid was correct and that the form was reasonably complete. If you are missing anything they will send a request for more evidence (RFE).

Having only filed an I-130 petition, you're on the CR1 visa path, not K3.

Follow this guide for the K-3. When you file I-130, you have filed for CR-1. If you follow this up with I-129F then you have filed for both CR-1 and K-3.

(I'm going for the IR-1 and blowing off the K-3. Even if it takes an extra couple months, it's worth it to not have to deal with USCIS again)

"Give me your tired, your poor, your huddled masses yearning to breathe free, the wretched refuse of your teeming shore. Send these, the homeless, tempest-tost to me, I lift my lamp beside the golden door!"

Note:

Please fill out I-130, wait 6 months for approval, then 3 more months for an interview. (Unless of course we've bombed your country into the stone age, then you qualify for expedited processing.)

Welcome to the USA!!!

Are you sure? We filled also a I-130 and we want a K3 visa... it seems like possible also

Yes, I'm absolutely certain. See the word "only" bolded above, then see the K3 guide.
