Quitting K3 for I-130/CR1???

Hi!

An existential question:

We are waiting for both I-130 (submitted last April) + K3 (subm. last June) NOA 2. Only yesterday I realized the marvelous advantages and ben€fit$ of quitting K3 and keeping the I-130/CR1 process. My question is: what’s the deadline to do it? (yes, we called USCIS, but no one knew the answer, as usual..). Is it too late to quit K3 after NOA 2? Or after the process arrives at the embassy? or... ???

What do you mean I-130 + K3? I-130 is the form you use to Petition for Alien Relative, which is a part of K3. K3 is a VISA which you receive when both I-130 and I-129F were approved plus all the necessary processing. After the USCIS approves the I-129F, it sends it to the NVC. The NVC sends the petition to the embassy in the country where the marriage took place.

Once your I-130 is approved, you can file Form I-824, Application for Action on an Approved Application or Petition. This also means an extra $340 plus an additional amount of waiting time.

Chances are, CSC will forward both petitions to NVC anyway. VSC is definitely not holding I-130s anymore and CSC doesn't seem to be either.

You need not cancel the I-129F/K3 process to pursue the CR1. Don't even try, or you can mess up your whole process for either visa. You can simply let the K3 process proceed normally while pushing the I-130 through NVC as fast as possible. Check the CR1 forum for the latest and greatest methods for speeding up the NVC process.

Later on, if the I-130 arrives at the Consulate before the K3 interview date, you can use that appointment for a CR1 interview, saving even more time.

Agreed. Just pursue both. This is what I did.

I have been given an interview on August 14th for my K3.

At the same time, I pursued the CR1 with the NVC. My case was complete on July 16th at NVC. They gave me an interview date of September 23rd for the CR1.

I called the Embassy and explained my situation. Embassy called NVC, told them to expidite my file. Embassy told me when they receive my file from the NVC, they will let me know and they will change my interview from a K3 to a CR1.

So by pursuing both, I will get the interview approx 6 weeks earlier.

It can work this way at any Consulate. Some are more cooperative than others but if your I-130/CR1/IR1 case file is on station at the Consulate, they are not allowed to issue a K3 visa because an immigrant visa is immediately available. Their definition of immidiately available is "case file on station".
