Finally, the lawyer managed to finish the lawsuit and send it in.. official date is 7/29/2008.. so hopefully 60 days from now I will have an answer.. :whistle: more retarded answers from the 1-800 call center.. now they said my case is still at the LOS ANGELES office, and still doing the so-called "background/security checks"..

yet I received a service request email from them on 7/9/2008 stating:

"The status of this service request is:

This case is in process and was sent to the USCIS local office in Los Angeles in November, 2007 for field review and investigation. The case file is currently in transit to this location, California Service Center. You will be notified by mail when a decision has been made or if additional evidence would be needed."

Hi Gogo,

It looks like we are in a similar circumstance. Our NOA1 is June 5, 2007 and our application is still stuck in "security/background checks". At this point it is unclear exactly where it is. Up until recently it was with an "outside agency" (fbi), but the most recent reply to our last congressional inquiry said it was with their "background check unit" and to allow six weeks, and we would receive notice by mail of any action or request for further information. A month has gone by since then, so our lawyer checked again and its still in security check. Once the six weeks is up our congressional rep will make another inquiry. If its still stuck in the security black hole by then we are going ahead with a Writ of Mandamus.

The good news is that at least we are waiting together now. I have been here in Argentina since December of 2007 waiting for this to be resolved. Still, the waiting and not knowing is killing us. We want to get to the US and start our life already, and here we are in purgatory.

I wish you both all the luck in the world. I really hope you get good news very soon!

I am very interested to know how the Writ is going and what their response will be (and when they respond) as it looks like that is our next step.

Hi guys, sorry I was just away.. today is day 38 / 60 of our writ of mandamus.. I see that the lawsuit is pretty successful (90%+) rating, it just takes about 4 months time on average to get something.. I also created an account here

I really appreciate it :thumbs: It has been too long for us.. recently, they said the file is "in transit" to CSC.. doesn't really know what that means.. called many times and got different answers.. It takes them from November 2007 to June 2008 to transfer to CSC.. just give it to me and I can drive from Los Angeles to Laguna Niguel (1 hour away?).. :bonk: I can even walk there in 7 months time.. sheesh..

kelah and ramiro, try to write a letter to the FBI (or White House).. and this is for anyone else who has problems.. As you know, I wrote plenty of letters and faxes bombarding anyone who works in the government (governor, senators, presidential nominees (yes, McCain, Obama, Hilary) and other state senators as well.. Also, White House, Ombudsman, Attorney generals, whoever had a name linked with the word "immigration").. anyway, the president fowarded my letter to Dept of Justice who forwarded to FBI.. they sent a letter (in the mail) back to my home saying I had no security checks (from Director of Records Management, Michael Cannon).. so USCIS is lying to me.. that is excellent proof to have and also written in the lawsuit (if you are going to do one).. what else can they say now? SOMEONE is lying (either FBI or USCIS, and I place my bets that it is not FBI's fault).. after 17 months waiting I lean heavily in favor of USCIS as the culprit..

hello

we sent in our k1 application over one year ago they receipted it on the 24th of sept last year

every inquiry states we are in security check or additional review.....congressional inquiry many things we have done and we dont get anyplace............at this point i think they are never going to approve us or deny us.........and i sure dont have the money that the attorney requires to do what u did do u have any suggestions?
