K3 or CR1

Hello all

Just quickly, my situation is that I have had my I129F and I130 approved from VSC (hooray) The NVC has processed my I129F and we have a letter from them indicating that the London embassy will receive my application within a week.

My question is, at what point can I apply for the CR1 and not the K3? At the moment, everything is moving towards a K3 interview but seeing as I have an approved I130 - can I apply now for the CR1? And how does one do that? Am i waiting for another approval from NVC regarding my I130?

Appreciate any help/advice.

If your I-130 was forwarded to the NVC, you can just follow the process with the NVC for your CR1. Here is a link where you can read the proceedures to get through the NVC in 4 to 6 weeks. http://www.visajourney.com/forums/index.php?showtopic=136822 .

I am currently following both paths. But you do not need to do this. You can just ignore the K3 if you want.

That is absolutely brilliant - really thorough information thanks very much. I'll ask my missus to call NVC and see if they have received my I130.

In the meantime I guess I should just continue with the K3 route. If the I130 gets approved quickly, then bingo

You can call, it is a recorded msg. You just need the case number from the USCIS, and they will give you the NVC case number. 1-603-334-0700.

They don't always forward the I-130 if you indicated you wanted a K-3. Vermont may be different, but my kids I-130 was approved May 8th at the CSC and the NVC has never received it. It may have gone to the National Records Center for safekeeping, pending adjustment of status. I made three phone calls yesterday trying to locate it. On the receipt it says they sent it to the NVC, so if the kids really decide they want the CR-1, I will try to hold the USCIS to their word. Go forward with the K-3. If the I-130 gets forwarded, that's wonderful! They already have an interview for July 24th.

It is so hard to tell what will happen cuz every case is handled differently.

We filed CR1 in June 07

it was approved in July 08

We also did K3, hoping we could get him here sooner

K3 was filed in July 07 and not approved until late Dec 07

so how does that seem right?

K3 did come quick after approval

finally had his interview March 27, 2008

got AP

12 days of AP and visa in hand

HERE IS OUR KICKER

visa in hand April 10, 2008 and interview for CR1 ON SAME DAY!!!!!!!!!!!!!!

so which route now?

attorney advised us to wait out for the interview for CR1

CR1 interview was May 15, 2008

AP YET AGAIN!!!!!!!!!!!!!!!

now it has been 7 weeks and we are completely distraught

I would advise anyone, if the distance is breaking you down, just do the K3, at least you can be together for some time

this is entirely too too much

just grasping at straws requesting assistance from Congressman and now the Senator and still will never know when that call for the visa will come

he could of been here back in April

soooooooo i think our situation is unique and i think we want to save money by just letting him get the green card there but it has been to difficult

our life is hold

ultimately it took 1 month for CR1 visa petition approval

10 months for CR1 interview...7 weeks AP

5 1/2 months for K3 visa petition approval

8 1/2 months for K3 interview...12 days AP

good luck to you whatever you decide and i am not sure how much help a lawyer really is

That is indeed good advice, my wife and I just want to be together - as Im sure we all do. Although AOS once in the States in a pain, we will be together. The benefits of a CR1 are great, but our time together is more precious

From what I've read on these forums, getting visas to the US in the UK is a whole different ball game than getting a visa from Morocco. I haven't heard any horror stories from the former. My sympathy goes out to the last poster. The OP might want to get input from those from the UK. As for the kids, it's full speed ahead for the K-3 at this point, but that is Thailand, where even the consular officers smile, so I've heard.
