Bad news guys.

"your visa has been denied under section 212(a)(2)(a)(1) of the immigration act A waiver of the applicable is available."

I dont know what this means, he has old convictions, which we were worried about, but i think 212 is lack of proof of relationship? my fiance told me: "I dont qualify for automatic approval its up to homeland security to approve me a waiver, only this time we both have to write letters explaining why a denial would cause extreme hardship, more forms to fill, $538 to pay, at least 15 weeks more to wait, "

We are eligible for a waiver but have to prove extreme hardship.

I am utterly heartbroken and crushed. He cannot even visit me til we get approved or denied. I am gutted! I dont know what to do! I cant be with the man i love! I have to go cry now!

07/31/08 CHECK WAS CASHED!

07/28/08 touched!!

12/08/08 NOA2 FINALLY!

12/13/08 NOA2 received in the mail

12/18/08 Called NVC at (603)334-0700 and talked to a nice lady named Rose. Our case was received on the13th and was sent out to sydney...WE WILL SEE!

12/13/08 NVC received letter and said they sent out to Sydney

12/18/08 received letter in the mail from NVC.

12/19/08 another letter from NVC stating it was shipped out

12/24/08 ARRIVED IN SYDNEY at 10:26 am and signed by tom

12/29/08 CONFIRMED it is at Sydney and Good ol Tom did sign for it LOL THANKS TOM!!

12/29/08 Sydney waiting for paper file from nvc and has it requested

12/31/08 Sydney confirmed through email that the paper file was received

01/05/09 His police checks are done and sent off!!

01/28/09 Kai went to his medicals forgot one of his passport pics and needs two more shots all was good!

2/18/09 medicals ready to be picked

2/20/09 packet 3 sent in

2/26/09 pkt 3 received today takes UP to 10 days

04/07/09 interview....APPROVED!!!!

04/20/09 He flew in ..flight was changed he was 3 hours late BUT HE IS HOME

port of entry took 2 mins!! LOL

04/25/09 WE ARE MARRIED!!!!!!!!!!

thanks meri! we are gonna file a waiver. will probly need an attorney, it will be about 5k or more so that will be our wedding/honeymoon money. so we can scrap the idea of any type of actual wedding if we are blessed enough to have one.

honestly, he doesnt make enough, he cant afford me to move there. he barely gets by himself. I know its romantic to say, 'if i had to live in a cardboard box to be with him, i would!' but thats just not realistic. have to try n fight it then if we lose, think of something else.

Would it not be cheaper to look at going to UK marrying and then applying for a UK spousal visa? I think i have seen posted here on VJ that it will cost about £1000 ($1500) so alot cheaper and then you would be able to apply for work, which would def be a plus in supporting each other financially.

I know that you have the cats to move over etc, but all in it would probably be cheaper than the $7500 for an attorney here and still have a long wait with the possibility of still being denied.

Jenny i saw on FB that it will cost about $7500 for an attorney!!! That is crazy.

Would it not be cheaper to look at going to UK marrying and then applying for a UK spousal visa? I think i have seen posted here on VJ that it will cost about £1000 ($1500) so alot cheaper and then you would be able to apply for work, which would def be a plus in supporting each other financially.

I know that you have the cats to move over etc, but all in it would probably be cheaper than the $7500 for an attorney here and still have a long wait with the possibility of still being denied.

Well because I dont want to move to the UK, i want to stay here. Even if i moved there and did the K3, i couldnt bring Paul back with me. If we did get back to the US he'd get turned down at the AOS stage.

A waiver is my last shot at staying in my country. If i get the waiver he can come here n get approved at AOS. While the attorney is a fortune, its worth a shot!

You don't need to do AOS if you CR-1, I believe (which is probably the quickest and easiest way to move back to the U.S as husband and wife). I have no idea if he would be turned down for the same thing with the CR-1 though, I'm guessing there is a stage where they check the criminal record.

So yeah, perhaps your options are the waiver (to get Paul to come to you) or moving to the UK (which on the plus, is cheaper and quicker than applying for a waiver). I understand you don't want to move. I hope you make the best decision for you.

This morning I passed my driving test YAY ! I looked on the permit and the date of expiration is august 16th like my I-94. So I asked what I will have to do after this date and they told me to comeback with my california driving license, and a proof of status (EAD or GC) and the will re-send me a new one, I will maybe just have to have a new picture done, that is it. So no need to retake the test !

I've been applying for jobs, editing my work, and trying to get an overhaul of my website up before the weekend. I think Andy and I are both losing our minds with the distance right now. I think the long hours at a job he doesn't like and living in a strange place has just made it that much more difficult for him. And for me, it's frustrating to finally have a little time on my hands and not be able to spend it with him.

How are our newlywed couples doing here? Still in post-marital bliss, or are the realities of living in a new country showing yet?
