urgent concerning sponsoring

Hi there everyone!

I have mentioned on a different thread that we are facing the following situation:

Maya (the petitioner), has just started working. she is above the minimum status required, but the problem is that she has just started working. (just = this month). She can get a letter from employer (which is a hospital, she's doing her medicine specialization), but we're still unsure whether to opt for this option, or whether it is not a good idea because she hasn't been working for a year.

The other option is to have her brother, who has been working since several years in the u.s., to sponsor us.

My first question is: what do you think is better (it's a fact that psychologically and emotionally, it is better if we could rely on ourselves solely), but there is the risk issue. so what do you think?

My second question, and this is what is confusing me most. If we opt for option two, will her brother be the sole sponsor or do they have to BOTH sponsor me. everyone of them alone is above the minimum, but i am trying to understand whether she should sponsor too, even if her brother is sponsoring because she is my Fiancée (and not her brother :D ) or it doesn't matter?

Thirdly, please tell me that it is not required that she (she is petitioner) comes to the consulate interview with me. it is almost impossible and the plane ticket will cost so much. is it required?

Finally, there are so many things to prepare... and my mind is getting very disorganized. :wacko:

If Maya did not have a job before this or assets she will not be able to sponsor you. You will be forced to get a sponsor.

I suggest she does get that letter from her employer anyhow.

Have her employer write the letter. The Consulate will care mostly about what she is making right now and from here on out.

She and him will be joint sponsors. She will need to file a notorized I-134 and provide supporting documentation as well. So... that's two. ;) Whether or not you use her brother is completely up to you. You could have all of the information with you just in case.

No, it's not required she go to the interview. However, some consulates perfer it that way. I have no idea about Lebanon.

All of these answers are in the guides and faq's up above. You will find that it will do you well to have a good read through all of the information here as you enter into this next step. You will also want to check the portals/regional threads regarding the Consulate in Lebanon to see if there is anything specific to that Embassy you should know about.

You might want to have your fiance call or fax the Dept of State's Visa Information Office (not the same as the NVC).

They were quite helpful. They do allow you to talk to a person, but only after being on hold for awhile.

They said my son should write a letter explaining his situation and have it notarized in addition to submitting the I-134. He only started working this year (recent college graduate), and did not file taxes last year as he had no taxable income. We are co-sponsoring only if they won't give her the visa without it. He'll be at the embassy for the interview, so can just pull it out of the file if needed.

I had just started my job after college when Vipul had his visa interview and we didn't have any problems as far as the I-134 goes. I just submitted what tax transcripts I had, employment letter, and whatever else I had as far as finances goes. We went through New Delhi though and some embassies are more strict and have different expectation. Check with someone who has gone through your embassy or check the embassy's website.

Your USC fiance wil always be the sponsor (not matter what or if she is making anything). A cosponsor (if you use them) will just be in addition.

I did not attend the visa interview with Vipul, and he didn't have any problems with that either.

December 19th - Vipul arrives in US

March 22, 2006 - Applied for AOS, EAD, and AP

June 6, 2006 - AP approved

June 9, 2006 - EAD approved

Feb. 5, 2007 - Becomes permanent resident

Dec. 9, 2008 - Filed I-751 to remove conditions

February 2009 - Conditions Removed - Next step Naturalization

November 19, 2009 - Filed for Naturalization!
