Hi all..

I hope this is not a dumb question..If my friend has just the religious cermony in Peru, can she apply for the k1 or k3 visa? Will they give her the marraige certificate? TYIA

If the religious cermony results in a marriage certificate from court or ministry then she would be technically married and has to go thru k-3.

Thanks so much!!.. She is of the understanding she has to do both the civil cerimony AND the religious cerimony to get the certificate.. And wants the k3?.. I think.. :wacko:

depends on the marriage laws in Peru. If a religious ceremony is a legal ceremony and the priest/minister can issue legal marriage certificates, then no, she won't need the civil ceremony also. However, if the marriage laws in Peru state that a religious ceremony is not a legal marriage, then yes, she will have to be married in a civil ceremony in order to qualify for a K3.

She'll have to check the laws in her country.

Be careful if you are considering a K1 because even a "pretend" wedding can be considered a marriage by USCIS. The best now would be getting a marriage certificate and then pursue the K3 or CR1

No need to play with fire. If you want to marry in Peru, do so and then follow a spouse visa path. If you want to marry in the US, don't marry in Peru. You really can't have it both ways.
